<h4>15.1 Our liability and that of each Carrier involved in your journey will be determined by each Carrier&rsquo;s respective Conditions of Carriage. The provisions on liability applicable to us are as follows:</h4>

<p>15.1.1 Unless otherwise stated herein, our liability in the case of international travel, as defined in the Convention, shall be in accordance with the principles of practice on liability (liability rules) provided in the Convention.</p>

<p>15.1.2 Where your carriage is not subject to the liability rules of the Convention, the following rules shall apply:</p>

<p>15.1.2(a) Any liability we have for Damage will be reduced by any negligence, on your part, which resulted in or caused the Damage in accordance with applicable law;</p>

<p>15.1.2(b) We will be liable only for Damage occurring during carriage on flights or flight segments where our Airline Designator Code appears in the Carrier box of the Ticket for that specific flight or flight segment. If we issue a Ticket or if we check Baggage for carriage on another Carrier, we do so only as agent for the other Carrier. Nevertheless, with respect to Checked Baggage, you may make a claim against the first or last Carrier of your journey;</p>

<p>15.1.2(c) We will not be liable for Damage to Unchecked Baggage unless such Damage is caused by our negligence;</p>

<p>15.1.2(d) We are not liable for any Damage arising from our compliance with applicable laws or Government rules and regulations, or from your failure to comply with the same;</p>

<p>15.1.2(e) Where the Warsaw Convention applies to your journey, our liability for Damage shall be limited to US $20 per kilogram, and US $400 per Passenger. Where the Montreal Convention applies to your journey, our liability for Damage shall be limited to SDR 1,519&nbsp;for Checked and Unchecked Baggage, subject to the applicable laws which prescribe different limits on liability. In this regard, SDR is a Special Drawing Right as defined by the International Monetary Fund (IMF). The value of SDR 1 is approximately US $1.33, but this rate of conversion may fluctuate. For the purposes of the Warsaw Convention, if the weight of the Baggage is not recorded on the Checked Baggage Identification Tag, it is presumed that the total weight of the Checked Baggage does not exceed the applicable free baggage allowance for the class of carriage concerned. If the Checked Baggage has a higher value than that which is declared in writing pursuant to an excess valuation facility, our liability shall be limited to such higher declared value. The foregoing shall not apply if the Damage was caused by an act or omission, or act of negligence.</p>

<p>15.1.2(f) Except as otherwise specified in these Conditions, we shall be liable to you only for recoverable compensatory Damages for proven losses and costs in accordance with the Convention.</p>

<p>15.1.2(g) We are not liable for any Damage caused by your Baggage. You shall be responsible for any Damage caused by your Baggage to other persons or property, including our property.</p>

<p>15.1.2(h) We shall bear no liability whatsoever for Damage to articles not permitted to be contained in Checked Baggage under Article 8.3, including fragile or perishable items, items having a special value, such as money, jewelry, precious metals, computers, personal electronic devices, bills of exchange, securities, medication or medical equipment, or other valuables, business documents, passports and other identification documents.</p>

<p>15.1.2(i) We are not be liable for the following minor damages and baggage irregularities which are beyond our control such as:</p>

<ul>
	<li>Minor torn, scratches, dents, dirt and stain</li>
	<li>Loss of external locks, key lock, padlock, security straps</li>
	<li>Loss of accessories; name tags, keychain, cover</li>
	<li>Rubber or plastic wheel covers deterioration</li>
</ul>

<p>15.1.2(j) We are not responsible for any illness, injury or disability, including death, attributable to your physical condition or for the aggravation of such condition.</p>

<p>15.1.2(k) The contract of carriage, including these Conditions of Carriage and exclusions or limits of liability, applies to our Authorized Agents, service providers, employees and representatives to the same extent as they apply to us. The total amount recoverable from us and from such Authorized Agents, employees, representatives and persons shall not exceed the amount of our own liability, if any.</p>

<p>15.1.2(l) Nothing in these Conditions of Carriage shall waive any exclusion or limitation of our liability under the Convention or applicable laws unless otherwise expressly stated.</p>

<h4>15.2 Warsaw Convention</h4>

<p>Unless otherwise stated herein, international carriage, as defined in the Convention, is subject to the liability rules of the Convention.</p>

<h4>15.3 Death of or Injury to Passengers</h4>

<p>15.3.1 Our liability for Damage sustained in the event of death, wounding or any other bodily injury by a Passenger in the event of an accident shall not be subject to any financial limit, be it defined by law, convention or contract.</p>

<p>15.3.2 Any Damage up to the sum of the equivalent of SDR 113,100 shall be excluded from our scope of liability.</p>

<p>15.3.3 Notwithstanding the provisions of Article 15.3.2, if we prove that the Damage was caused by, or contributed to by, the negligence, unlawful act or omission of the injured or deceased Passenger, we may be held free from responsibility for such Damage, whether in whole or in part, proportionate to Damage so caused or contributed to by such negligence, unlawful act or omission accordingly.</p>

<p>15.3.4 We shall, within fifteen (15) Days after the identity of the natural person entitled to compensation or indemnification has been established, make the advance payments as may be required to meet the immediate economic needs on a basis proportionate to the hardship suffered.</p>

<p>15.3.5 Without prejudice to Article 15.3.5, an advance payment shall not be less than the equivalent of SDR 16,000 per Passenger in the event of death.</p>

<p>15.3.6 An advance payment shall not constitute the recognition of liability and may be offset against any subsequent sums paid on the basis of our liability, but is not returnable, except in the cases described in Article 15.3.4 or in circumstances where it is subsequently proved that the person who received the advance payment caused, or contributed to, the Damage by negligence or was not the person entitled to compensation.</p>


Liability for Damage

<h4>3.1 General Provisions</h4>

<p>3.1.1 We will provide information on the named Passenger on the Ticket to the air Carriers. Passengers may be required to produce appropriate identification in order to travel.</p>

<p>3.1.2 A Ticket is non-transferable or non-negotiable.</p>

<p>3.1.3 Some Tickets are sold at discounted fares which may be partially or completely non-refundable. You should choose the fare best suited to your needs. You may also wish to ensure that you have acquired representations or warranties that you have obtained appropriate insurance to cover incidents or instances where you have to cancel your Ticket.</p>

<p>3.1.4 If you have a Ticket as provided in 3.1.3 above, which is unused, and you are prevented from traveling due to a Force Majeure, you must promptly advise us thereof and furnish evidence of such Force Majeure. In such case, we will provide you with a credit of the non-refundable amount of the air fare for future travel with us, subject to deductions of a reasonable administration fee.</p>

<p>3.1.5 The Ticket is, and remains at all times, the property of the issuing Carrier.</p>

<p>3.1.6 Except in the case of an Electronic Ticket, you are not entitled to be carried on a flight unless you present a valid Ticket containing the Flight Coupon for that flight, and all other Flight Coupons and the Passenger Coupon. In addition, you are not entitled to be carried on board a flight if the Ticket presented is in connection with a multilateral interline traffic agreement, or if the said Ticket has been altered by a party other than by us or our Authorized Agent. In the case of an Electronic Ticket, you are not entitled to be carried on board a flight unless you are able to provide positive identification and a valid Electronic Ticket duly issued by us, and in your name.</p>

<p>3.1.7 (a) In the case of loss or multilateral Ticket (whether in whole or in part), whether by you or a non-representation of the Ticket, which comprise Passenger Coupon and all unused Flight Coupons, upon your request, we will replace such Ticket (whether in whole or in part) by issuing a new Ticket, provided that there is evidence, readily verifiable at that time, that a Ticket valid for the flight(s) in questionwas duly issued, and you sign an agreement to reimburse us for any costs and losses, up to the value of the original Ticket, which are necessarily and reasonable incurred by us or another Carrier for misuse of the Ticket. We will not claim for reimbursement from you for any such losses resulting from our own negligence. The Ticket-issuing Carrier may charge a reasonable administration fee for such service, unless in the case of multilateral loss due to a fault attributable to the negligence of another Carrier or its agent.</p>

<p>3.1.7 (b) Where there is a lack of evidence or the evidence is unavailable, or you do not sign the aforementioned agreement, the Carrier issuing the new Ticket may request that you pay the full Ticket price for the replacement Ticket, subject to a refund if the issuing Carrier of the existing Ticket has checked the relevant information and is satisfied, based on the available evidence, that the multilateral interline Ticket has not been used before the expiry of its validity. If you present such Ticket to the Carrier issuing the new Ticket, the refund shall be processed at that time.</p>

<p>3.1.8 A Ticket is valuable. You are advised to take appropriate measures to safeguard your Ticket and ensure that it is not lost or stolen.</p>

<h4>3.2 Period of Validity</h4>

<p>3.2.1 Unless as otherwise provided in the Ticket, these Conditions of Carriage, or in the applicable Tariffs (which may limit the period of validity of a Ticket, in which case, any such limitation shall be indicated on the Ticket), a Ticket is valid for:</p>

<p>3.2.1 (a) One year from the date of issuance; or</p>

<p>3.2.1 (b) Subject to the initial travel occurring within one year from the date of issuance of the relevant document, one year from the date of the commencement of the journey as per the Ticket.</p>

<p>3.2.2 If you are unable to travel within the period of validity of the Ticket given that we were unable to confirm your reservation immediately at the time which you request to make a reservation, the validity period of such Ticket shall be extended. Alternatively, you may request for a refund in accordance with Article 10 hereof.</p>

<p>3.2.3 If, after having commenced your journey, you are unable to travel within the validity period of the Ticket by reason of illness, we may extend the validity period of your Ticket until a date on which you are fit for travel or until our first flight after such date, from the place where the journey is resumed, provided that there is space available in the class of service for which the fare was paid. Such illness shall be evidenced by a medical certificate. If the Flight Coupon appears on the Ticket, or in the case of an Electronic Ticket or Electronic Coupon involving one or more Stopover(s), the validity period of the Ticket may be further extended, subject to the maximum extension of three months from the date specified on the medical certificate. In such circumstance, we will similarly extend the validity period of the Tickets of other members of your immediate family accompanying you.</p>

<p>3.2.4 In the event of death of a Passenger on route, the validity period of the Tickets of the persons accompanying the deceased Passenger shall likewise be extended, whether by means of the waiver of the minimum stay, or by means of an extension of the period of validity. In the event of a death in the immediate family of a Passenger who has commenced his/her travel, the validity of the said Passenger&rsquo;s Tickets and those of his/her immediate family members who are accompanying the Passenger in question may likewise be extended. Any such extension shall be given upon receipt of a valid death certificate, and shall not be longer than the period of 45 Days from the date of death.</p>

<h4>3.3 Coupon Sequence and Use</h4>

<p>3.3.1 The Ticket you have purchased is valid only for the travel as shown on the Ticket, from the place of departure via any Agreed Stopping Places, to the final destination. The Fare you have paid is based upon our Tariff and is valid for the travel as shown on the Ticket. It forms an essential part of our contract with you. The Ticket will not be honored and will lose its validity if Coupons are not used in the sequence provided in the Ticket.</p>

<p>3.3.2 If you wish to change any aspect of your travel, you must contact us in advance. The fare for your new travel will be calculated, and you will be given the option of accepting the new price or maintaining your original travel as ticketed. Should you be required to change any aspect of your travel due to Force Majeure, you must contact us as soon as practicable, whereby we will use reasonable efforts to transport you to your next Stopover or final destination, without a recalculation of the fare.</p>

<p>3.3.3 Should you change your transportation without our agreement, we will assess the correct price for your actual travel. You will have to pay any difference between the price you have paid and the total price applicable for your revised travel. We will refund you the difference if the new price is lower but otherwise, your unused Coupons have no value.</p>

<p>3.3.4 Please be aware that while some types of changes will not result in a change of fare, others, such as changing the place of departure (for example, if you do not fly the first segment) or reversing the direction you travel, can result in an increase in price. Many fares are valid only on the dates and for the flights shown on the Ticket and may not be changed at all, or only upon payment of an additional fee.</p>

<p>3.3.5 Each Flight Coupon contained in your Ticket will be accepted for transportation in the class of service on the date and flight for which space has been reserved. When a Ticket is originally issued without a reservation being specified, space may be later reserved subject to our Tariff and the availability of space on the flight requested.</p>

<p>3.3.6 Please be advised that in the event you do not show up for any flight without advising us in advance, we may cancel your return or onward reservations. However, if you do advise us in advance, we will not cancel your subsequent flight reservations.</p>

<h4>3.4 Name and Address of Carrier</h4>

<p>Our name may be abbreviated to our Airline Designator Code, or otherwise, in the Ticket. Our address is Bangkok Airways Public Co., Ltd., 99 Mu 14, Vibhavadirangsit Road, ChomPhon, Chatuchak, Bangkok 10900, Thailand.</p>

<h4>4.1 Fares</h4>

<p>Fares apply only for carriage from the airport at the point of origin to the airport at the point of destination, unless otherwise expressly stated. Fares do not include ground transport service between airports and between airports and town terminals. Your fare will be calculated in accordance with our Tariff in effect on the date of payment of your ticket for travel on the specific dates and itinerary shown on it. If you change your itinerary or dates of travel, this may impact the fare to be paid.</p>

<h4>4.2 Taxes, Fees and Charges</h4>

<p>Applicable taxes, fees and charges imposed by the Government or other authority, or by the operator of an airport, shall be payable by you. At the time you purchase your Ticket, you will be advised of the applicable taxes, fees and charges not included in the fare, most of which will normally be shown separately on the Ticket. The taxes, fees and charges imposed on air travel are constantly changing and can be imposed after the date of Ticket issuance. If there is an increase in a tax, fee or charge shown on the Ticket, you will be obliged to pay it. Likewise, if a new tax, fee or charge is imposed even after Ticket issuance, you will be obliged to pay it. Vice versa, in the event any tax, fee or charge which you have paid to us at the time of Ticket issuance is abolished or reduced such that they no longer apply to you, or a lesser amount is due, you will be entitled to claim a refund.</p>

<h4>4.3 Currency</h4>

<p>Fares, taxes, fees and charges are payable in the currency of the country in which the Ticket is issued, unless another currency is indicated by us or our Authorized Agent, at or before the time payment is made (for example, because of the non-convertibility of the local currency). We may at our discretion, accept payment in another currency.</p>

<h4>4.4 No Show Fee</h4>

<p>No Show Fee (Penalty) will be applied on the fare paid for the Ticket, based on the class of the Ticket as defined below, which are non-refundable fares.<br />

<h4>Penalties of Domestic fare - TH:</h4>

<p>Any change or cancellation of reservation made after the original flight departure are considered no-show and the no-show fee of THB 500 for economy class, and THB 1,000 for premium economy and business classes will be applied.</p>

<h4>Penalties of International fare - ORG TH:</h4>

<p>Any change or cancellation of reservation made after the original flight departure are considered no-show and the no-show fee of THB 1,000 for economy class, and THB 2,000 for premium economy and business classes will be applied.</p>

<h4>Penalties of International fare - ORG KH:</h4>

<p>Any change or cancellation of reservation made after the original flight departure are considered no-show and the no-show fee of USD 30 will be applied.</p>

<h4>Waived Fares:</h4>

<ul>
	<li>FFP Resident Card ( Samui Resident, Trat Privilege, Sukhothai Privilege )</li>
	<li>Corporate Fare and Government Fare</li>
	<li>Code Share Fare</li>
</ul>

<p>All of the above fares and the No Show Fee will be automatically charged for ticket issuance from 01 November 2017.</p>

<h4>๔.๑ ค่าโดยสาร</h4>

<p>อัตราค่าโดยสารจะคิดจากผู้ให้บริการสายการบินโดยเริ่มต้นคำนวณจากท่าอากาศยานที่เป็นจุดเริ่มต้น ไปยังท่าอากาศยานที่เป็นจุดหมายปลายทาง เว้นแต่มีการกำหนดไว้เป็นอย่างอื่น โดยอัตราค่าโดยสารจะไม่ครอบคลุมการบริการขนส่งภาคพื้นดินระหว่างท่าอากาศยานต่าง ๆ และระหว่างท่าอากาศยานต่าง ๆ ไปยังชานชลาที่อยู่ในเมือง ทั้งนี้ การคำนวณอัตราค่าโดยสารของผู้โดยสารจะเป็นไปตามอัตราค่าธรรมเนียมของสายการบิน ที่มีผลตั้งแต่วันที่ชำระเงินค่าบัตรโดยสารของผู้โดยสารสำหรับการเดินทางในวันที่กำหนด และตามตารางกำหนดการเดินทางที่แสดงไว้ โดยหากผู้โดยสารประสงค์จะขอเปลี่ยนแปลงตารางกำหนดการเดินทาง หรือวันที่เดินทาง ในส่วนนี้จะส่งผลกระทบต่อค่าบัตรโดยสารที่ได้ชำระไปก่อนหน้านี้แล้ว</p>

<h4>๔.๒ ภาษี ค่าธรรมเนียม และค่าใช้จ่ายที่เรียกเก็บต่าง ๆ</h4>

<p>ในส่วนของภาษี ค่าธรรมเนียม และค่าใช้จ่ายอื่น ๆ ที่เรียกเก็บตามที่รัฐบาล หรือหน่วยงานที่มีอำนาจหน้าที่ หรือตามที่ผู้ดูแลท่าอากาศยาน กำหนด โดยให้ถือเป็นส่วนที่ผู้โดยสารต้องรับผิดชอบชำระ ซึ่งในช่วงเวลาที่ผู้โดยสารซื้อบัตรโดยสารของผู้โดยสาร ผู้โดยสารจะได้ทราบถึงจำนวนภาษี ค่าธรรมเนียม และค่าใช้จ่ายอื่น ๆ ที่มิได้รวมอยู่ในค่าบัตรโดยสาร ซึ่งโดยส่วนใหญ่จะแสดงรายการแยกออกไว้ในบัตรโดยสาร ทั้งนี้ในส่วนของภาษี ค่าธรรมเนียม และค่าใช้จ่ายอื่น ๆ จะมีการเปลี่ยนแปลงไปตามการเดินทาง และจะกำหนดชัด ณ วันที่มีการออกบัตรโดยสาร โดยหากมีการปรับภาษี ค่าธรรมเนียม และค่าใช้จ่ายอื่น ๆ เพิ่มขึ้น ก็จะแสดงไว้ในบัตรโดยสาร ซึ่งแน่นอนว่า เป็นส่วนที่ผู้โดยสารจะต้องชำระ เช่นเดียวกัน หากมีการกำหนดจำนวนภาษี ค่าธรรมเนียม และค่าใช้จ่ายอื่น ๆ ใหม่ แม้แต่ภายหลังจากที่มีการออกบัตรโดยสารนั้น ๆ แล้วก็ตาม ผู้โดยสารก็ยังต้องเป็นผู้ชำระด้วยเช่นกัน ในทางกลับกัน หากมีการยกเลิก หรือลดจำนวนภาษี ค่าธรรมเนียม และค่าใช้จ่ายอื่น ๆ ซึ่งผู้โดยสารได้ชำระไว้กับสายการบิน ณ เวลาที่มีการออกบัตรโดยสารแล้ว และไม่ได้มีผลผูกพันใด ๆ กับผู้โดยสารอีกต่อไป หรือหากเป็นจำนวนเงินน้อยกว่าที่กำหนด ผู้โดยสารก็จะสามารถเรียกร้องขอรับเงินคืนได้ด้วยเช่นกัน</p>

<h4>๔.๓ สกุลเงิน</h4>

<p>ค่าบัตรโดยสาร ภาษี ค่าธรรมเนียม และค่าใช้จ่ายอื่น ๆ ให้ชำระในสกุลเงินของประเทศที่มีการออกบัตรโดยสารนั้น ๆ เว้นแต่ สายการบินหรือตัวแทนที่ถูกต้องตามกฎหมาย (authorized agent) ของสายการบินกำหนดให้มีการชำระโดยสกุลเงินอื่น ๆ ณ ช่วงเวลา หรือก่อนกำหนดการชำระเงิน (เนื่องจากไม่สามารถกลับค่าเงินเป็นสกุลเงินในระดับท้องถิ่น) โดยสายการบินอาจจะพิจารณา ยอมรับการชำระเงินในสกุลเงินอื่น ๆ</p>

<h4>๔.๔ ค่าธรรมเนียมกรณีที่ผู้โดยสารไม่แสดงตัวเพื่อขึ้นเครื่องโดยสาร (no show fee)</h4>

<p>กรณีที่ผู้โดยสารไม่แสดงตัวเพื่อขึ้นเครื่องโดยสารกำหนดให้ต้องเสียค่าปรับ (การลงโทษ) ตามฐานค่าบัตรโดยสาร และถือเป็นส่วนของค่าบัตรโดยสารที่ไม่สามารถขอ โดยมีสนนราคาตามชั้นต่าง ๆ ดังนี้<br />

<h4>การกำหนดมาตรการลงโทษ (ค่าปรับ) ของบัตรโดยสารภายในประเทศ TH:</h4>

<p>การเปลี่ยนแปลง หรือการขอยกเลิกการสำรองบัตรโดยสารที่ทำหลังจากที่มีการใช้บัตรโดยสารขาออกเดิม ให้ถือเป็นกรณีผู้โดยสารไม่แสดงตัวเพื่อขึ้นเครื่องโดยสาร ซึ่งกำหนดให้ต้องเสียค่าปรับ (การลงโทษ) จำนวน ๕๐๐ บาทสำหรับชั้นประหยัด และจำนวน ๑,๐๐๐ บาท สำหรับชั้นประหยัดพิเศษ (premium economy) และชั้นธุรกิจ</p>

<h4>การกำหนดมาตรการลงโทษ (ค่าปรับ) ของบัตรโดยสารระหว่างประเทศ ORG TH:</h4>

<p>Passengers reading these Conditions of Carriage consider and acknowledge the following definitions.</p>

<p>&ldquo;We&rdquo;, &ldquo;our&rdquo;, &ldquo;ourselves&rdquo;, and &ldquo;us&rdquo; means Bangkok Airways.</p>

<p>&ldquo;You&rdquo;, &ldquo;your&rdquo;, &ldquo;yourself&rdquo;, and &ldquo;Passenger&rdquo; means any person, with the exception of crew members,carried or to be carried in an aircraft in accordance with aTicket.</p>

<p>&ldquo;Agreed Stopping Places&rdquo; means those agreed stopping places, with the exception of the place of departure and the place of destination,as specified in the Ticket or shown in ourtimetables, as the scheduled stopping places inthe route on which you are travelling.</p>

<p>&ldquo;Airline Designator Code&rdquo; means a two-character or three-letter code designated for identifyingparticular air Carriers.</p>

<p>&ldquo;Authorized Agent&rdquo; means a Ticket sales agent that we have authorizedto sell Tickets to Passengers on our behalf in the sale of air carriage services.</p>

<p>&ldquo;Baggage&rdquo; means your personal properties/belongings accompanying you/ which you bring onboard the aircraft in connection with your journey.Unless otherwise specified, the term Baggage hereunder comprises both your Checked Baggage and Unchecked Baggage.</p>

<p>&ldquo;Baggage Check&rdquo; means the portion of a Ticket which shows the information relation to the carriage of yourChecked Baggage.</p>

<p>&ldquo;Baggage Identification Tag&rdquo; means a document is issued to you for the purpose of identifying Checked Baggage.</p>

<p>&ldquo;Carrier&rdquo; means an air carrier, other than ourselves, whose Airline Designator Code is indicated on your Ticket or Conjunction Ticket.</p>

<p>&ldquo;Checked Baggage&rdquo; means Baggage taken into our custody and for whichwe have issued a Baggage Identification Tag.</p>

<p>&ldquo;Check-in Deadline&rdquo; means the time limit for check-in service specified by us, by which you shall have completedthe check-in formalities and received your boarding pass.</p>

<p>&ldquo;Conjunction Ticket&rdquo; means a Ticket issued to you which also contains another Ticket for passage which together constitute a single contract of carriage.</p>

<p>&ldquo;Convention&rdquo; means any of the following instruments being applicable:</p>

<ol>
	<li>The Convention for the Unification of Certain Rules relating to International Carriage by Air, signed in Warsaw on 12 October 1929 (hereinafter referred to as the &ldquo;Warsaw Convention&rdquo;);</li>
	<li>The Warsaw Convention as amended at the Hague on 28 September 1955;</li>
	<li>The Warsaw Convention as amended by Additional Protocol No.1 of Montreal (1975);</li>
	<li>The Warsaw Convention as amended at the Hague and by Additional Protocol No.2 of Montreal (1975);</li>
	<li>The Warsaw Convention as amended at the Hague and by Additional Protocol No.4 of Montreal (1975);</li>
	<li>The Guadalajara supplementary Convention (1961); and</li>
	<li>The Montreal Convention (1999).</li>
</ol>

<p>&ldquo;Coupon&rdquo; means an Electronic Coupon or paper Coupon, each of which entitle the named passenger to travel on the particular flight identified on it.</p>

<p>&ldquo;Damage&rdquo; means death, wounding, or bodily injury to a Passenger, loss arising from partial loss, theft, or other damage, whether arising out of or in connection with carriage or other services incidental thereto performed by us.</p>

<p>&ldquo;Days&rdquo; means calendar days, including all seven days of the week; provided that, for the purpose of notification, the day upon which notice is given shall not be counter, and provided that, for the purposes of determining the validity period of a Ticket, the day on which a Ticket is issued, or the day on which the flight commences, shall not be counter.</p>

<p>&ldquo;Electronic Coupon&rdquo; means the electronic Flight Coupon or other value document kept in our database.</p>

<p>&ldquo;Electronic Ticket&rdquo; means the Itinerary/Receipt issued by us or on our behalf, in the form of an Electronic Coupon and a boarding document.</p>

<p>&ldquo;Flight Coupon&rdquo; means any portion of the Ticket that bears the wording &ldquo;Good for Passage&rdquo;, or in the case of an Electronic Ticket, the Electronic Coupon and any portion which indicates the particular places between which you are entitled to be carried.</p>

<p>&ldquo;Force Majeure&rdquo; means unusual and unforeseeable circumstances beyond your control, the consequences of which could not have been avoided even if due care had been exercised.</p>

<p>&ldquo;Itinerary/Receipt&rdquo; means a document or documents we issue to Passengers traveling on Electronic Tickets that contain(s) the Passenger&rsquo;s name, flight information, and notices.</p>

<p>&ldquo;Notice of Contract Terms Incorporated by Reference&rdquo; means those statements contained in or delivered with your Ticket or Itinerary/Receipt, identified as such and which incorporate by reference, these Conditions of Carriage and notices.</p>

<p>&ldquo;Passenger&rdquo; means any person, except members of the crew, carried or to be carried in an aircraft pursuant to a Ticket (See also definition for &quot;you&quot;, &quot;your&quot; and &quot;yourself&quot; above).</p>

<p>&ldquo;Passenger Coupon&rdquo; or &ldquo;Passenger Receipt&rdquo; means the portion of the Ticket issued by us or on our behalf, which is so marked and issued in the interest of maximizing usage relating to the Passenger.</p>

<p>&ldquo;Special Drawing Rights&rdquo; are a special international unit of account under the law governing the granting of authority and prescribing specific practices relating to the special drawing rights as defined by the International Monetary Fund.</p>

<p>&ldquo;Stopover&rdquo; means a scheduled stop on your journey, at a point between the place of departure and the place of destination.</p>

<p>&ldquo;Tariff&rdquo; means the published fares, charges and/or related Conditions of Carriage of an airline filed, where required and as appropriate, with the competent authorities.</p>

<p>&ldquo;Ticket&rdquo; means either the document entitled &quot;Passenger Ticket and Baggage Check&quot; or the Electronic Ticket, in each case issued by us or on our behalf, and includes the Conditions of Contract, notices and Coupons.</p>

<p>&ldquo;Unchecked Baggage&rdquo; means any of your Baggage other than Checked Baggage.</p>

<h4>8.1 Free Baggage Allowance</h4>

<p>You may carry some Baggage, free of charge, subject to our conditions and restrictions, which are indicated on your Ticket.</p>

<h4>8.2 Excess Baggage</h4>

<p>You will be required to pay a charge for carriage of Baggage in excess of the free Baggage allowance, at rates specified by us, and available from us or our Authorized Agents.</p>

<h4>8.3 Items Unacceptable as Baggage</h4>

<p>8.3.1 Your Baggage shall not include the following items:</p>

<p>8.3.1.1 Items which are likely to endanger the aircraft or persons or property on board the aircraft, such as those specified in the International Civil Aviation Organization (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air and the International Air Transport Association (IATA) Dangerous Goods Regulations, and in our regulations (further information is available from us on request);</p>

<p>8.3.1.2 Items the carriage by air of which is prohibited by the applicable laws, practice regulations or orders of any state;</p>

<p>8.3.1.3 Items which are reasonably considered by us to be unsuitable for carriage because they are dangerous, unsafe or by reason of their weight, size, sharpness or shape, or which are fragile or perishable having regard to, among other things, the type of aircraft being used. Information about unacceptable items is available upon request.</p>

<p>8.3.2 Firearms and ammunition other than for hunting and sporting purposes are prohibited from carriage as Baggage. Firearms and ammunition for hunting and sporting purposes may be accepted as Checked Baggage. Firearms must be unloaded with the safety catch on, and suitably packed. The carriage of ammunition is subject to the ICAO and IATA regulations as provided in Article 8.3.1.1.</p>

<p>8.3.3 Weapons such as antique firearms, swords, knives and similar items may be accepted as Checked Baggage, at our discretion, but are not permitted in the cabin of the aircraft.</p>

<p>8.3.4 Items which shall not be stored in your Checked Baggage include, for example, cash, jewelry, precious metals, computers, personal electronic devices, bills of exchange, securities or other valuables, business documents, passports and other identification documents.</p>

<p>8.3.5 If any item referred to in Articles 8.3.1, 8.3.2 and 8.3.4 are included in your Baggage, we shall not be responsible for any loss or Damage to such items, provided that such loss or Damage is not due to a fault attributable to the air carrier, our employees, or agent.</p>

<h4>8.4 Right to Refuse Carriage</h4>

<p>8.4.1 Subject to Articles 8.3.2 and 8.3.3, we will refuse to carry as Baggage the items described in Article 8.3, and we may refuse further carriage of any such items upon discovery.</p>

<p>8.4.2 We may refuse to carry as Baggage any item reasonably considered by us to be unsuitable for carriage due to its size, shape, weight, content, character, or for safety or operational reasons, or for the comfort of other passengers. Information about unacceptable items is available upon request.</p>

<p>8.4.3 We may refuse to accept Baggage for carriage in the cabin, unless the Baggage is suitably packaged for carriage based on our reasonable view. Information on the packaging and containers unacceptable to us is available upon request.</p>

<h4>8.5 Right of Search</h4>

<p>We may request that you permit, for safety and security reasons, a body search, or a scan or x-ray of your Baggage. If you are not available at the time of any search, your Baggage may be searched in your absence for the purpose of determining whether you are in possession of or whether your Baggage contains any items described in Article 8.3.1, or any firearms, ammunition or weapons, which have not been presented to us in accordance with Articles 8.3.2 or 8.3.3. If you are unwilling to comply with such request, we may refuse the carriage of you and your Baggage. In the event that a search or scan causes Damage to you, or an x-ray or scan causes Damage to your Baggage, we shall not be liable for such Damage unless due to our fault or negligence.</p>

<h4>8.6 Checked Baggage</h4>

<p>8.6.1 Upon delivery to us of your Baggage which you wish to have carried with you as Checked Baggage, we will take custody of, and issue a Baggage Identification Tag for, each piece of your Checked Baggage.</p>

<p>8.6.2 Checked Baggage must have your name or other personal identification affixed to it.</p>

<p>8.6.3 Checked Baggage will, whenever possible, be carried on the same aircraft on which you have boarded, unless the same is otherwise carried on another flight for safety, security or operational reasons. If your Checked Baggage is carried on a subsequent flight, we will deliver it to you, unless the applicable law requires you to be present for customs clearance.</p>

<h4>8.7 Unchecked Baggage</h4>

<p>8.7.1 We may specify maximum dimensions and/or weight for Baggage which you carry onto the aircraft. If we have not done so, note that Baggage which you carry onto the aircraft must fit under the seat in front of you or in an enclosed storage compartment in the cabin of the aircraft. If your Baggage cannot be stored in this manner, or is of excessive weight, or is considered unsafe for any reason, it must be checked and stored in cabin compartment (Unchecked Baggage).</p>

<p>8.7.2 Objects not suitable for carriage in the cargo compartment above the seats in the cabin (such as delicate musical instruments), and which do not meet the requirements in Article 8.7.1 above, will only be accepted for carriage in the cabin compartment if you have given us advance notice and permission has been granted by us. You may have to pay a separate charge for this service.</p>

<h4>8.8 Collection and Delivery of Checked Baggage</h4>

<p>8.8.1 Subject to Article 8.6.3, you are required to collect your Checked Baggage as soon as it is made available at your destination or Stopover. If you do not collect it within a reasonable time, we may charge you a storage fee. If you fail to claim the Checked Baggage which we have stored for you within three (3) months from the time it is made available, we may dispose of it without any liability to you.</p>

<p>8.8.2 Only the bearer of the Baggage Check and Baggage Identification Tag, is entitled to claim the Checked Baggage.</p>

<p>8.8.3 If a person claiming Checked Baggage is unable to identify his/her Checked Baggage by means of producing the corresponding Baggage Identification Tag, we will deliver the Baggage to such person only on condition that he or she produces, to our satisfaction, any evidence or practice in accordance with our prescribed conditions, proving his or her right to the Baggage.</p>

<h4>8.9 Animals</h4>

<p>If we agree to carry your animals, they will be carried subject to the following conditions:</p>

<p>8.9.1 You must ensure that animals, whether dogs, cats, pet birds, and other pet animals are in good health and are properly crated. They shall be accompanied by valid health and vaccination certificates, entry permits, and other documents required by countries of entry or transit, failing which, they will not be accepted for carriage. Such carriage may be subject to additional conditions specified by us.</p>

<p>8.9.2 If accepted as Baggage, the animal, together with its cage, container and food, shall not be included in your free Baggage allowance, but shall constitute excess baggage, for which you will be obliged to pay the applicable rate.</p>

<p>8.9.3 Guide dogs accompanying Passengers with disabilities will be carried free of charge in addition to the normal free Baggage allowance, subject to conditions specified by us.</p>

<p>8.9.4 Where carriage is not subject to the liability rules of the Convention, we are not responsible for any injury to or loss, sickness or death of an animal which we have agreed to carry unless such injury, loss, sickness or death is due to our negligence.</p>

<p>8.9.5 We shall bear no liability in respect of any such animal failing to meet the requirements for exit, entry, health and other documents with respect to the animal&#39;s entry into or passage through any country, state or territory. The person carrying the animal must reimburse us for any fines, costs, losses or liabilities reasonably imposed or incurred by us as a result thereof.</p>

<h4>8.10 Items Removed by Airport Security Personnel</h4>

<p>We will not be responsible for, or bear any liability in respect of, articles removed from your Baggage by airport security personnel acting in accordance with any applicable regulations.</p>

<h4>10.1 We will refund a Ticket or any unused portion, in accordance with the applicable fare rules or Tariff, as follows:</h4>

<p>10.1.1 Except as otherwise provided herein, we will make a refund either to the person named in the Ticket or, to the person who has paid for the Ticket, upon presentation of satisfactory proof of such payment.</p>

<p>10.1.2 If a Ticket has been paid for by a person other than the Passenger named in the Ticket, and the Ticket indicates that there is a restriction on refund, we shall make a refund only to the person who paid for the Ticket, or to another person as instructed by the person who pad for the Ticket.</p>

<p>10.1.3 In the case of a lost Ticket, refunds will only be made upon the presentation of evidence of the unused Ticket and all unused Flight Coupons or Electronic Ticket.</p>

<h4>10.2 Involuntary Refunds</h4>

<p>10.2.1 If we cancel a flight or fail to operate a flight reasonably according to schedule, fail to stop at your destination or Stopover, or cause you to miss a connecting flight on which you hold a reservation, the amount of the refund shall be as follows:</p>

<p>&nbsp;&nbsp;10.2.1.1 If no portion of the Ticket has been used, an amount equal to the fare paid;</p>

<p>10.2.1.2 If a portion of the Ticket has been used, the refund will be not less than the fare paid for the unused portion of the Ticket.</p>

<h4>10.3 Voluntary Refunds</h4>

<p>10.3.1 If you are entitled to a refund of your Ticket for reasons other than those set out in Article 10.2, the amount of the refund shall be as follows:</p>

<p>&nbsp; 10.3.1.1 If no portion of the Ticket has been used, an amount equal to the fare paid, less any reasonable service charges or fees for processing the refund;</p>

<p>&nbsp;&nbsp; 10.3.1.2 If a portion of the Ticket has been used, the refund will be an amount equal to the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used, less any reasonable service charges or fees for processing the refund.</p>

<h4>10.4 Refund on Lost Ticket</h4>

<p>10.4.1 If you lose your Ticket or any portion of it, upon furnishing us with satisfactory proof of the loss, and of the evidence of payment for such Ticket, a refund will be made as soon as practicable after the expiry of the validity period of the Ticket, subject to the following conditions:</p>

<p>&nbsp;&nbsp; 10.4.1.1 The lost Ticket, or the unused portion thereof, has not been used, we will give you a refund or issue you a new Ticket (a Ticket for which a refund or replacement cannot be sought is a Ticket resulting from our own negligence);</p>

<p>&nbsp;&nbsp; 10.4.1.2 The person to whom the refund is made shall repay to us the amount refunded in the event of fraud and/or to the extent that the lost Ticket or portion of it is used by a third party (except where any fraud or use by a third party resulted from our own negligence).</p>

<p>10.4.2 If we or our Authorized Agent lose the Ticket or any portion of it, the loss shall be our responsibility.</p>

<h4>10.5 Right to Refuse Refund</h4>

<p>10.5.1 We may refuse a refund where application is made after one year from the date on which the Ticket was issued.</p>

<p>10.5.2 We may refuse a refund on a Ticket which has been presented to us, or to Government officials, as evidence of the intention to depart from that country, unless you establish, to our satisfaction, that you have permission to remain in the country or that you will depart from that country by another Carrier or another means of transport.</p>

<h4>10.6 Currency</h4>

<p>We reserve the right to make a refund in the same manner and the same currency used to pay for the Ticket.</p>

<h4>10.7 Persons Eligible to Make Refunds</h4>

<p>Voluntary refunds will be made only by the Carrier which originally issued the Ticket or by its agent if so authorized.</p>


<h4>๑๐.๑ สายการบินจะคืนเงินค่าบัตรโดยสาร หรือเงินบางส่วน ตามกฎข้อบังคับที่ว่าด้วยค่าโดยสารหรือค่าธรรมเนียม ที่เกี่ยวข้อง ดังนี้</h4>

<p>๑๐.๑.๑ สายการบินจะคืนเงินให้กับผู้ที่มีชื่อชื่อในบัตรโดยสาร หรือบุคคลที่เป็นผู้ชำระค่าบัตรโดยสาร โดยสามารถแสดงหลักฐาน และการยืนยันถึงการชำระเงินค่าบัตรโดยสารดังกล่าว (เว้นแต่มีการกำหนดไว้เป็นอย่างอื่น มิเช่นนั้นให้เป็นไปตามบทบัญญัติในข้อนี้)</p>

<p>๑๐.๑.๒ หากบัตรโดยสารได้มีการชำระโดยบุคคลอื่นที่ไม่ได้ระบุว่าเป็นผู้โดยสาร และบัตรโดยสารนั้น ๆ ได้กำหนดเงื่อนไขหรือข้อจำกัดในการขอรับเงินคืน โดยสายการบินจะขอพิจารณาคืนเงินให้กับบุคคลที่เป็นผู้ชำระค่าบัตรโดยสารเท่านั้น หรือตามที่บุคคลนั้น ๆ ระบุ</p>

<p>๑๐.๑.๓ ในกรณีที่บัตรสูญหาย สายการบินจะทำการคืนเงินค่าโดยสารตามที่ผู้โดยสารสามารถแสดงหลักฐานบัตรโดยสารและส่วนของบัตรโดยสารหรือบัตรโดยสารอิเล็กทรอนิกส์ ที่ยังไม่ได้ใช้</p>

<h4>๑๐.๒ การขอรับเงินคืนจากการกระทำที่เกิดขึ้นโดยไม่สมัครใจ (involuntary refund)</h4>

<p>๑๐.๒.๑ หากสายการบินเป็นผู้ขอยกเลิกเที่ยวบิน ไม่สามารถดำเนินการบินได้ตามตารางการบิน โดยมีเหตุผล ไม่สามารถหยุด ณ จุดหมายปลายทางของผู้โดยสาร หรือสถานที่แวะพัก หรือเป็นเหตุให้ผู้โดยสารพลาดการต่อเที่ยวบิน ตามที่ผู้โดยสารได้ทำการจองบัตรโดยสารไว้ จำนวนเงินที่สามารถขอรับคืนจะมีรายละเอียดดังต่อไปนี้</p>

<p>๑๐.๒.๑.๑ หากบัตรโดยสารไม่ถูกใช้งาน สายการบินจะคืนเงินให้กับผู้โดยสารเท่ากับจำนวนเงินที่ได้ชำระไปจริง</p>

<p>๑๐.๒.๑.๒ หากบัตรโดยสารได้ถูกใช้งานแล้วในบางขาเที่ยวบิน สายการบินจะคืนเงินให้กับผู้โดยสารไม่ต่ำกว่าจำนวนเงินค่าบัตรโดยสารที่ยังไม่ได้เดินทาง</p>

<h4>๑๐.๓ การขอรับเงินคืนจากการกระทำที่เกิดขึ้นโดยสมัครใจ (voluntary refund)</h4>

<p>๑๐.๓.๑ หากผู้โดยสารเป็นผู้มีสิทธิสำหรับการขอรับเงินค่าบัตรโดยสาร มากกว่าที่กำหนดไว้ในข้อ ๑๐.๒ ให้พิจารณาจำนวนเงินคืน ดังนี้</p>

<p>๑๐.๓.๑.๑ หากบัตรโดยสารไม่ถูกใช้ จะได้รับเงินคืนเท่ากับจำนวนค่าบัตรโดยสารที่ได้ชำระไป โดยหักชำระค่าธรรมเนียมการบริการอื่น ๆ หรือค่าธรรมเนียมการขอคืนบัตรโดยสาร</p>

<p>๑๐.๓.๑.๒ หากบัตรโดยสารถูกใช้งานบางส่วน จะได้รับเงินคืนเท่ากับส่วนต่างระหว่างค่าบัตรโดยสารที่ได้ชำระไปแล้ว กับค่าบัตรโดยสารที่ถูกใช้ โดยหักชำระค่าธรรมเนียมการบริการอื่น ๆ หรือค่าธรรมเนียมการขอคืนบัตรโดยสาร</p>

<h4>๑๐.๔ การขอรับเงินคืนในกรณีบัตรโดยสารสูญหาย</h4>

<p>๑๐.๔.๑. ในกรณีที่ผู้โดยสารทำบัตรโดยสาร หรือส่วนใดส่วนหนึ่งของบัตรโดยสารสูญหาย และผู้โดยสารสามารถแสดงหลักฐานพิสูจน์ทราบการสูญหาย พร้อมทั้งหลักฐานการชำระเงิน สายการบินจะดำเนินการคืนเงินให้เร็วที่สุด หลังจากบัตรโดยสารสิ้นสภาพการใช้งาน ภายใต้เงื่อนไขดังต่อไปนี้</p>

<p>๑๐.๔.๑.๑ ในกรณีที่ผู้โดยสารทำบัตรโดยสาร หรือส่วนใดส่วนหนึ่งของบัตรโดยสารสูญหาย ยังไม่ได้นำมาใช้งาน สายการบินจะคืนเงิน หรือออกบัตรโดยสารใหม่ (บัตรโดยสารที่ไม่สามารถคืนเงินหรือออกบัตรโดยสารใหม่ได้ คือ บัตรโดยสารที่เกิดจากความประมาทเลินเล่อของสายการบิน)</p>

<p>๑๐.๔.๑.๒ ในกรณีที่บุคคลซึ่งมาดำเนินการขอรับเงินคืนไปแล้ว และมีการตรวจพบว่า กรณีที่เกิดขึ้นเป็นการหลอกลวง หรือบัตรโดยสารมีการถูกใช้หรือสูญหายโดยบุคคลที่สาม ผู้โดยสารจะต้องนำเงินดังกล่าวมาคืนให้กับสายการบิน ยกเว้นเกิดจากความประมาทเลินเล่อของสายการบิน</p>

<p>๑๐.๔.๒ หากสายการบิน หรือตัวแทนของสายการบิน (authorized agent) ทำบัตรโดยสาร หรือส่วนใดส่วนหนึ่งของบัตรโดยสารสูญหาย การสูญหายนั้น ๆ ถือเป็นความรับผิดชอบทั้งหมดของสายการบิน</p>

<h4>๑๐.๕ การสงวนสิทธิ์ในการปฏิเสธการขอรับเงินคืน</h4>

<p>๑๐.๕.๑ สายการบินจะปฏิเสธการขอรับเงินคืน ในกรณีได้รับแจ้งการดำเนินการขอรับเงินคืน ภายหลังจากที่บัตรโดยสารดังกล่าวได้มีการออกมาแล้วกว่าหนึ่งปี</p>

<p>๑๐.๕.๒ สายการบินจะปฏิเสธการขอรับเงินคืน ในกรณีที่พบว่า บัตรโดยสารที่นำมาแสดงให้กับสายการบิน หรือต่อเจ้าหน้าที่รัฐ เป็นหลักฐานที่แสดงเจตนาจะขอออกจากประเทศ เว้นแต่ผู้โดยสารจะสามารถพิสูจน์ให้สายการบินเห็นว่า ผู้โดยสารได้รับอนุญาตให้อยู่ในประเทศ หรือว่า ผู้โดยสารจะออกจากประเทศ โดยสายการบินอื่น หรือวิธีการขนส่งประเภทอื่น</p>

<h4>๑๐.๖ สกุลเงิน</h4>

<p>สายการบินขอสงวนสิทธิ์ในการพิจารณาให้เงินคืนในลักษณะเดียวกัน และในสกุลเงินเดียวกันกับที่ใช้ชำระค่าบัตรโดยสาร</p>

<p>This notice cannot be used as a basis for a claim for compensation, nor to interpret the provisions of the Regulation or the Montreal Convention or the Warsaw Convention, and it does not form part of the contract between the carrier and you. No representation is made by the carrier as to the accuracy of the contents of this notice.</p>

<p>Passengers on a journey involving an ultimate destination or a stop in a country other than the country of departure are advised that international treaties known as the Montreal convention, or its predecessor, the Warsaw convention, including its amendments (the Warsaw convention system), may apply to the entire journey, including any portion thereof within a country. For such passengers, the applicable treaty, including special contracts of carriage embodied in any applicable&nbsp;tariffs, governs and may limit the liability of the carrier.</p>

<p>EC Regulation No. 889/2002 requires European Community carriers to apply the provisions of the Montreal Convention limits to all carriage by them of passengers and their baggage by air. Many non-European Community carriers have elected to do so in respect of the carriage of passengers and their baggage.</p>

Above that amount, the air carrier can defend itself against a claim by proving that it was not negligent or otherwise at fault.</p>

<h4>7.1 Right to Refuse Carriage</h4>

<p>In the reasonable exercise of our discretion, we may refuse to carry you or your Baggage onboard if we have notified you in writing that we would not at any time after the date of such notice, carry you on our flights. In this case, you will be entitled to a refund. We may also refuse to carry you or your Baggage onboard if any of the following have occurred or if we reasonably believe that any of the following may occur:</p>

<p>7.1.1 The refusal of carriage is necessary in order to comply with any applicable laws, regulations, or orders of the government;</p>

<p>7.1.2 The carriage of you or your Baggage may endanger or affect the safety, health, or materially affect the comfort of other Passengers or crew; such as odorous fruits, or strong-smelling items. In this regard, all Bangkok Airways Flights are non-smoking. In addition, the use of &quot;e-cigarettes&quot; and smoking on any flight operated by Bangkok Airways&#39; code share are strictly prohibited.</p>

<p>7.1.3 Your mental or physical state, including your impairment from alcohol or drugs, presents a hazard or risk to yourself, other Passengers, the crew, or to property;</p>

<p>7.1.4 You have committed a misconduct on a previous flight, and we have reason to believe that such conduct may reoccur;</p>

<p>7.1.5 You refused to submit to or give cooperation in a security check;</p>

<p>7.1.6 You failed to pay any applicable fare, tax, fee or charge;</p>

<p>7.1.7 You do not appear to have valid travel documents, seek to enter a country through which you may be in transit, or for which you do not have valid travel documents, your travel documents were destroyed during a flight, or you refused to surrender your travel documents to the flight crew upon being prompted to do so by the flight crew;</p>

<p>7.1.8 You present a Ticket that has been acquired unlawfully, has been purchased from an entity other than us or our Authorized Agent, or has been reported as being lost or stolen, is a counterfeit, or you cannot prove that you are the person named in the ticket;</p>

<p>7.1.9 You have failed to comply with the requirements set forth in Article 3.3 above concerning Coupon sequence and use, or you present a Ticket which has been issued or altered in any way by an entity other than by us or our Authorized Agent, or the Ticket is mutilated;</p>

<p>7.1.10 You fail to comply with our instructions with respect to safety or security.</p>

<h4>7.2 Special Assistance</h4>

<p>Acceptance of the carriage of unaccompanied children<a href="#_ftn1" name="_ftnref1" title="">[1]</a>, incapacitated persons, pregnant women, persons with illness or persons requiring special assistance, is subject to our discretion and prior arrangement with us. Passengers with disabilities who have advised us of any special requirements they may have at the time of ticketing, and been accepted by us, shall not subsequently be denied carriage on the basis of such disability or special requirements.</p>

<h4>๗.๑ สิทธิในการปฏิเสธการเดินทาง</h4>

<p>ในการดำเนินการใด ๆ ที่เป็นไปตามการพิจารณาไตร่ตรองของสายการบินอย่างมีเหตุและผลแล้ว สายการบินอาจจะขอปฏิเสธที่จะให้ผู้โดยสารขึ้นโดยสารในอากาศยาน หรือนำกระเป๋าสัมภาระของผู้โดยสารขึ้นอากาศยาน หากสายการบินได้แจ้งให้ผู้โดยสารได้ทราบเป็นลายลักษณ์อักษรแล้วว่า สายการบินจะไม่ดำเนินการในเวลาใด ๆ หลังจากที่วันที่ได้นำส่งใบแจ้งดังกล่าวให้กับผู้โดยสารเกี่ยวกับเที่ยวบินของผู้โดยสารแล้ว ผู้โดยสารสามารถเรียกรับเงินคืนได้ ทั้งนี้ สายการบินอาจจะขอปฏิเสธที่จะให้ผู้โดยสารขึ้นโดยสารในอากาศยาน หรือนำกระเป๋าสัมภาระของผู้โดยสารขึ้นอากาศยาน หากพบว่า มีลักษณะข้อหนึ่งข้อใดเกิดขึ้น หรือสายการบินมีเหตุผลที่เชื่อได้ว่า สิ่งต่าง ๆ เหล่านี้ ได้เกิดขึ้นจาก</p>

<p>๗.๑.๑ การดำเนินการต่าง ๆ ที่เป็นไปตามความจำเป็น เพื่อให้เกิดการปฏิบัติที่สอดคล้องกับกฎหมาย ระเบียบปฏิบัติ หรือคำสั่งต่าง ๆ ของรัฐบาลในส่วนที่เกี่ยวข้อง</p>

<p>๗.๑.๒ การที่จะให้ผู้โดยสารขึ้นโดยสารในอากาศยาน หรือการนำกระเป๋าสัมภาระของผู้โดยสารขึ้นอากาศยานอาจจะทำให้เกิดอันตราย หรือมีผลกระทบต่อความปลอดภัย สุขภาพ หรือผลกระทบต่อลักษณะทางกายภาพ ซึ่งทำให้เกิดลักษณะการก่อกวน สร้างความรำคาญ หรือความไม่สบายกับผู้โดยสาร หรือบรรดาพนักงานบริการบนอากาศยาน (ลูกเรือ) อาทิ ผลไม้ หรือสัมภาระต่าง ๆ ที่มีกลิ่นรุนแรง ทั้งนี้ สายการบินของบางกอกแอร์เวย์เป็นสายการบินปลอดบุหรี่ นอกจากนั้น ไม่อนุญาตให้นำ &ldquo;บุหรี่ไฟฟ้า&rdquo; มาใช้ รวมถึงการสูบบุหรี่บนอากาศยานต่าง ๆ ที่ดำเนินการโดยสายการบินร่วม หรือพันธมิตรของบางกอกแอร์เวย์ด้วย&nbsp;</p>

<p>๗.๑.๓ สภาพร่างกาย และจิตใจของผู้โดยสาร รวมถึงลักษณะความบกพร่อง หรือความไม่ปกติที่เกิดจากการดื่มเครื่องดื่มอัลกอฮอล์ หรือการใช้สารเสพติดต่าง ๆ ซึ่งจะทำให้เกิดอันตราย หรือความเสี่ยงต่อตัวผู้โดยสารเอง ผู้โดยสาร บรรดาพนักงานบริการบนอากาศยาน (ลูกเรือ) หรือต่อทรัพย์สินต่าง ๆ</p>

<p>๗.๑.๔ กรณีที่ผู้โดยสารมีพฤติกรรมใด ๆ ที่ไม่เหมาะสมในสายการบินก่อนหน้านั้น และสายการบินยังมีเหตุผลที่จะเชื่อได้ว่า ผู้โดยสารอาจจะกระทำพฤติกรรมนั้น ๆ เกิดขึ้นอีก</p>

<p>๗.๑.๕ ผู้โดยสารปฏิเสธที่จะนำส่ง หรือให้ความร่วมมือกับการตรวจสอบด้านความมั่นคงต่าง ๆ</p>

<p>๗.๑.๖ ผู้โดยสารมิได้ชำระค่าบัตรโดยสาร ค่าภาษี ค่าธรรมเนียม หรือค่าใช้จ่ายที่มีการเรียกเก็บใด ๆ ที่เกี่ยวข้อง</p>

<p>๗.๑.๗ ผู้โดยสารไม่สามารถแสดงเอกสารประกอบการเดินทางที่ถูกต้อง ชัดเจน สำหรับการเดินทางผ่าน (transit) ของผู้โดยสาร หรือการเดินทางเข้าประเทศที่ผู้โดยสารมิได้มีเอกสารการเดินทางที่ถูกต้อง การฉีกทำลายเอกสารการเดินทางของผู้โดยสารระหว่างเที่ยวบิน หรือการปฏิเสธการแสดงเอกสารการเดินทางของผู้โดยสารให้กับพนักงานบริการบนอากาศยาน (ลูกเรือ) ต่อการเรียกรับ เมื่อมีการแจ้งความประสงค์</p>

<p>๗.๑.๘ ผู้โดยสารใช้บัตรโดยสารเครื่องบินที่ไม่ถูกต้องตามกฎหมาย โดยอาจจะเป็นการจำหน่ายจากส่วนใด ๆ นอกเหนือจากสายการบิน หรือตัวแทนที่ถูกต้องตามกฎหมาย (authorized agent) ของสายการบิน หรือเป็นบัตรโดยสารที่มีผู้แจ้งว่าสูญหาย หรือถูกขโมย ซึ่งถือเป็นการกระทำที่มิชอบด้วยกฎหมาย หรือกรณีที่ผู้โดยสารไม่สามารถพิสูจน์ หรือยืนยันได้ว่า ผู้โดยสารเป็นบุคคลเดียวกันกับบุคคลที่มีชื่อปรากฏอยู่บนบัตรโดยสารนั้น ๆ</p>

<p>๗.๑.๙ ผู้โดยสารไม่สามารถดำเนินการตามข้อกำหนดที่บัญญัติไว้ในข้อ ๓.๓ ข้างต้นในส่วนที่เกี่ยวกับการใช้ และลำดับการใช้คูปอง หรือผู้โดยสารนำบัตรโดยสารที่มีการออก หรือการเปลี่ยนแปลงในทางหนึ่งทางใด นอกเหนือจากที่เป็นการดำเนินการโดยสายการบิน หรือตัวแทนที่ถูกต้องตามกฎหมาย (authorized agent) ของสายการบิน หรือกรณีที่เป็นบัตรโดยสารที่เกี่ยวข้องกับหลายฝ่าย</p>

<p>๗.๑.๑๐ ผู้โดยสารไม่สามารถปฏิบัติตามคำแนะนำในส่วนที่เกี่ยวกับความปลอดภัย หรือความมั่นคงได้</p>

<h4>๗.๒ การช่วยเหลือพิเศษ</h4>

<p>การยอมรับผู้โดยสารเด็กที่เดินทางโดยลำพังไม่มีผู้ปกครองเดินทางด้วย<a href="#_ftn1" name="_ftnref1" title="">[1]</a> (unaccompanied children)ผู้โดยสารที่ไร้ความสามารถช่วยเหลือตนเองไม่ได้ ผู้โดยสารตั้งครรภ์ บุคคลในภาวะป่วยหรือผู้ที่ต้องการความช่วยเหลือพิเศษ ที่ได้ดำเนินการแจ้งไว้ล่วงหน้าก่อนเดินทางจะได้รับการพิจารณาตามดุลยพินิจของสายการบิน ผู้โดยสารที่ทุพพลภาพและได้แจ้งให้กับทางสายการบินทราบถึงความต้องการพิเศษตั้งแต่จองบัตรโดยสาร และได้รับการยอมรับจากสายการบิน จะไม่ถูกปฏิเสธการเดินทางด้วยเหตุแห่งความทุพพลภาพหรือการต้องการการดูแลเป็นพิเศษ</p>

Refusal and Limitation of Carriage

<h4>5.1 Reservation Requirements</h4>

<p>5.1.1 We or our Authorized Agent will record your reservation(s). Upon request, we will provide you with a written confirmation of your reservation(s).</p>

<p>5.1.2 Certain fares have conditions which limit or exclude your right to change or cancel reservations.</p>

<h4>5.2 Ticketing Time Limits</h4>

<p>If you have not paid for the Ticket prior to the specified ticketing time limit as advised by us or our Authorized Agent, your reservation may be cancelled.</p>

<h4>5.3 Personal Data</h4>

<p>You recognize that your personal data has been given to us for the purposes of: making a reservation, purchasing a Ticket, obtaining ancillary/support services, developing and providing services, facilitating immigration procedures and formalities, and making data in connection with your travel available to government agencies for the purposes of inspection. For these purposes, you authorize us to retain and use such data and to submit the same to our own offices, Authorized Agents, government agencies, other Carriers or the providers of the aforementioned services.</p>

<h4>5.4 Seating</h4>

<p>We will endeavor to honor advance seating requests; however, we cannot guarantee any particular seat. We reserve the right to assign or reassign seats at any time, even after boarding of the aircraft. This may be necessary for operational, safety or security reasons.</p>

<h4>5.5 Reconfirmation of Reservations</h4>

<p>5.5.1 Onward or return reservations may be subject to specific reservation reconfirmation time limits. We will advise you when we require reconfirmation, and how and where it should be done. If reconfirmation is required and you fail to reconfirm your reservation, your onward or return reservation may be cancelled. However, if you advise us that you still wish to travel, and there is available seating on the flight, we will reinstate your reservation and transport you on the said flight. If there is no seat available on the flight, we will use our best efforts to transport you to your next or final destination.</p>

<p>5.5.2 You should check the reconfirmation requirements of other Carriers which you intend to use on your journey. If so required, you must reconfirm your reservation with the Carrier whose code appears for the flight in question on the Ticket.</p>

<h4>5.6 Cancellation of Onward Reservations</h4>

<p>Please be advised that if you do not show up for any flight without advising us in advance, your return or onward reservations may be cancelled. However, if you do advise us in advance, we will not cancel your subsequent flight reservations.</p>

<p>๕.๑.๑ สายการบิน หรือตัวแทนที่ถูกต้องตามกฎหมาย (authorized agent) ของสายการบินจะบันทึกการสำรองบัตรโดยสารของผู้โดยสาร โดยเป็นไปตามการแจ้งความประสงค์ ที่สายการบินจะจัดส่งรายการยืนยันการสำรองบัตรโดยสารของผู้โดยสาร โดยนำส่งเป็นเอกสารลายลักษณ์อักษรให้กับผู้โดยสาร</p>

<p>๕.๑.๒ การกำหนดค่าโดยสารแบบชัดเจนเป็นเงื่อนไขที่กำหนดให้จำกัด และแยกขาดออกจากสิทธิของผู้โดยสารในการขอเปลี่ยน หรือยกเลิกการสำรองบัตรโดยสารดังกล่าว</p>

<h4>๕.๒ กรอบเวลาในการออกบัตรโดยสาร</h4>

<p>หากผู้โดยสารยังมิได้ชำระค่าบัตรโดยสาร ก่อนถึงกำหนดเวลาการออกบัตรโดยสารตามที่กำหนด และได้รับคำแนะนำโดยสายการบิน หรือโดยตัวแทนที่ถูกต้องตามกฎหมาย (authorized agent) ของสายการบิน สายการบินขอยกเลิกการสำรองบัตรโดยสารของผู้โดยสารออกไปได้</p>

<h4>๕.๓ ข้อมูลส่วนบุคคล</h4>

<p>ผู้โดยสารตระหนักดีว่า ข้อมูลส่วนบุคคลที่นำเสนอให้กับสายการบินนั้น เป็นไปเพื่อ : การทำการสำรองบัตรโดยสาร การซื้อบัตรโดยสาร การขอรับบริการช่วยเหลือ/สนับสนุนต่าง ๆ การพัฒนาและการจัดหาการบริการ การอำนวยการด้านขั้นตอนการตรวจคนเข้าเมือง และพิธีการต่าง ๆ สำหรับการเดินทางเข้าเมือง และการเก็บรักษาข้อมูลเพื่อการตรวจสอบของหน่วยงานรัฐ ในส่วนที่เกี่ยวข้องกับการเดินทางของผู้โดยสารเป็นสำคัญ โดยวัตถุประสงค์ต่าง ๆ เหล่านี้ ผู้โดยสารได้อนุญาตให้สายการบินเก็บและใช้ข้อมูลนั้น ๆ และนำส่งข้อมูลดังกล่าวไปยังสำนักงานและตัวแทนที่ถูกต้องตามกฎหมาย (authorized agent) ของสายการบิน รวมถึงหน่วยงานภาครัฐ และบรรดาผู้ให้บริการการขนส่งเดินทางอื่น ๆ หรือผู้ให้บริการต่าง ๆ ตามที่กล่าวไว้ข้างต้น</p>

<h4>๕.๔ การกำหนด/เลือกที่นั่ง</h4>

<p>สายการบินจะใช้ความพยายามเป็นอย่างยิ่งในการจัดหา/กำหนดเลือกที่นั่งต่าง ๆ ให้กับผู้โดยสารไว้ก่อนล่วงหน้า อย่างไรก็ตาม หากสายการบินไม่สามารถยืนยันที่นั่งเป็นการจำเพาะให้กับผู้โดยสารได้ สายการบินขอสงวนสิทธิในการจัดการ หรือดูแลการจัดการที่นั่งของผู้โดยสารได้ตลอดเวลา แม้แต่หลังจากที่มีการนำผู้โดยสารเข้าที่นั่งบนอากาศยานแล้วก็ตาม ซึ่งในส่วนนี้อาจจะเป็นส่วนสำคัญในการปฏิบัติการ การสร้างความปลอดภัย หรือเหตุผลด้านความมั่นคงต่าง ๆ</p>

<h4>๕.๕ การยืนยันซ้ำสำหรับการสำรอง</h4>

<p>๕.๕.๑ สำหรับการสำรองทั้งในส่วนของขาไป หรือขากลับอาจจะมีการเปลี่ยนแปลงไปตามความจำเป็นในการยืนยันซ้ำสำหรับการสำรอง ภายในกรอบระยะเวลาที่กำหนด โดยสายการบินขอเรียนให้ผู้โดยสารทราบถึงระยะเวลาที่สายการบินจำเป็นจะต้องได้รับการยืนยันซ้ำ พร้อมทั้งขั้นตอนการดำเนินการ และสถานที่ซึ่งเกี่ยวข้องในการดำเนินการนั้น ๆ ทั้งนี้ หากมีความจำเป็นต้องดำเนินการดังกล่าว และผู้โดยสารไม่สามารถแจ้งยืนยันซ้ำได้ สายการบินอาจจะขอยกเลิกการสำรองของผู้โดยสารทั้งในส่วนขาไป หรือขากลับ แต่อย่างไรก็ตาม หากผู้โดยสารแจ้งให้สายการบินทราบว่า ผู้โดยสารยังประสงค์ที่จะเดินทาง และมีที่นั่งเหลือในเที่ยวบินดังกล่าว สายการบินจะขอนำการสำรองของผู้โดยสารกลับเข้าไปในระบบ และทำการเดินทางให้กับผู้โดยสาร หากไม่พบว่า มีที่นั่งเหลือในเที่ยวบินดังกล่าว สายการบินจะพยายามอย่างเต็มที่ เพื่อให้ผู้โดยสารสามารถเดินทางได้ในเที่ยวบินที่จะนำผู้โดยสารไปยังจุดหมายปลายทางถัดไป หรือในปลายทางที่ผู้โดยสารประสงค์จะทำการเดินทางนั้น ๆ</p>

<p>๕.๕.๒ ผู้โดยสารควรตรวจสอบการยืนยันซ้ำตามความประสงค์ของผู้โดยสาร กับบรรดาผู้ให้บริการการขนส่งอื่น ๆ ที่เกี่ยวข้องกับเส้นทางการเดินทางของผู้โดยสาร โดยในกรณีที่มีความจำเป็น ผู้โดยสารจำเป็นต้องยืนยันซ้ำกับผู้ให้บริการการขนส่งตามที่มีการแสดงรหัสการให้บริการนั้น ๆ สำหรับเที่ยวบินซึ่งมีข้อสงสัยเกี่ยวกับบัตรโดยสาร</p>

<h4>๕.๖ การยกเลิกการสำรองที่เข้ามา (cancellation of onward reservations)</h4>

<p>ขอนำเรียนให้ทราบว่า หากผู้โดยสารมิได้แสดงตัวสำหรับการเดินทางกับสายการบินใด ๆ โดยไม่ได้แจ้งให้สายการบินได้ทราบล่วงหน้า สายการบินอาจจะขอยกเลิกการสำรองทั้งในส่วนของขาไป หรือขากลับของผู้โดยสารออกไปก่อน อย่างไรก็ตาม หากผู้โดยสารได้แจ้งให้สายการบินทราบล่วงหน้าแล้ว สายการบินจะไม่ทำการยกเลิกการสำรองเที่ยวบินถัดไปของผู้โดยสารแต่อย่างใด</p>

<p><span class="text-big">13.1 General</span></p><p>13.1.1 You are responsible for obtaining all required travel documents and visas and for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, into or through which you transit.</p><p>13.1.2 We shall not be liable for the consequences to any Passenger resulting from his her failure to obtain such documents or visas or to comply with such laws, regulations, orders, demands, requirements, rules or instructions.</p><p><span class="text-big">13.2 Travel Documents</span></p><p>Prior to travel, you must present all exit, entry, health and other documents required by the laws, regulations, orders, demands or other requirements of the countries concerned, and permit us to make and retain copies thereof. We reserve the right to refuse carriage if you have not complied with these requirements, or your travel documents do not appear to be in order.</p><p>13.2.1 Required travel documents for international flights</p><p>Passengers travelling overseas are responsible for preparing all required travel documents and visas in compliance with the applicable laws of the countries of embarkation, transit, and destination.</p><p>13.2.2 Required travel documents for domestic flights</p><p>Passengers shall present their passport, Thai national identification card, or other official document issued by a Thai government authority which contains their photo (e.g. a government official card, driving license, or civil registry certificate) at the check-in counter and upon boarding the aircraft.</p><p>For infants and children holding a Thai nationality, their passport, national identification card, or the original of their birth certificate may be presented [at the check-in counter and upon boarding the aircraft].</p><p>Passengers who are foreign nationals shall present their passport or other identification document issued by a Thai government authority which contains their photo, namely:</p><p>- Non-Thai national identification card</p><p>These are the only documents valid for domestic travels.</p><p>Remark: Copies of identification documents cannot be used as valid identification documents for travel.</p><p><span class="text-big">13.3 Refusal of Entry</span></p><p>If you are denied entry into any country, you will be responsible to pay any fine or charge assessed and imposed on us by the relevant Government, and for the cost of transporting you from that country. The fare collected for carriage to the point of refusal or denied entry will not be refunded by us.</p><p><span class="text-big">13.4 Passenger Responsible for Fines, Detention Costs, Etc.</span></p><p>If we are required to pay any fine or penalty or to incur any expenditure by reason of your failure to comply with the laws, regulations, orders, requests, or demands in respect of other travel requirements of the countries concerned or to produce the required documents, you shall reimburse upon our request as per the actual amount so paid or expenditure so incurred. We may apply towards such payment or expenditure the value of any unused carriage on your Ticket, or any of your funds in our possession.</p><p><span class="text-big">13.5 Customs Inspection</span></p><p>If required or requested to do so, you shall attend the inspection of your Baggage by the Customs or other Government officials. We are not liable to you for any loss or Damage suffered by you in the course of such inspection or through your failure to comply with this requirement.</p><p><span class="text-big">13.6 Security Inspection</span></p><p>You shall submit to any security checks by the Government officials, airport officials, Carriers or by us.</p>

<p><span class="text-big">๑๓.๑ บททั่วไป</span></p><p>๑๓.๑.๑ ให้ถือว่าผู้โดยสารมีหน้าที่รับผิดชอบสำหรับการจัดทำเอกสารสำหรับการเดินทางตามที่กำหนด พร้อมทั้งการตรวจลงตรา (วีซ่า) และสำหรับการปฏิบัติใด ๆ ที่เป็นไปตามกฎหมาย ระเบียบปฏิบัติ คำสั่งการ คำร้องหรือความประสงค์ และเอกสารประกอบการเดินทางของแต่ละประเทศ ทั้งการเดินทางออกจาก ไปยัง หรือผ่านในประเทศต่าง ๆ ของผู้โดยสาร</p><p>๑๓.๑.๒ สายการบินจะไม่รับผิดชอบต่อเหตุการณ์ใด ๆ ทีเป็นผลมาจากการปฏิบัติของผู้โดยสารที่ล้มเหลว หรือมิได้มีการดำเนินการเพื่อจัดเตรียม หรือขอรับเอกสารนั้น ๆ หรือการตรวจลงตรา (วีซ่า) หรือการปฏิบัติใด ๆ ที่เป็นไปตามกฎหมาย ระเบียบปฏิบัติ คำสั่งการ คำร้อง หรือความประสงค์ ข้อกำหนด กฎหรือคำแนะนำต่าง ๆ</p><p><span class="text-big">๑๓.๒ เอกสารสำหรับการเดินทาง</span></p><p>ก่อนที่จะออกเดินทาง ผู้โดยสารต้องนำเสนอบรรดาเอกสารทั้งหมดที่เกี่ยวข้อง และมีอยู่ในส่วนที่เกี่ยวกับการเดินทางเข้าและออก สุขภาพ และอื่น ๆ ตามที่กฎหมาย ระเบียบปฏิบัติ คำสั่งการ คำร้อง หรือความประสงค์ ข้อกำหนดอื่น ๆ ของบรรดาประเทศที่เกี่ยวข้อง และต้องให้อนุญาตกับสายการบินในการรับเอา หรือเก็บรักษาข้อมูลของเอกสารนั้น ๆ ไว้หลังจากนั้น โดยที่สายการบินขอสงวนสิทธิ์ในการปฏิเสธการเดินทาง หากพบว่า ผู้โดยสารมิได้ปฏิบัติตามข้อกำหนดทั้งหลายเหล่านี้ หรือเอกสารการเดินทางของผู้โดยสารไม่เป็นไปตามข้อกำหนดดังกล่าว</p><p>๑๓.๒.๑ ข้อกำหนดเอกสารการเดินทางระหว่างประเทศ</p><p>ผู้โดยสารที่เดินทางระหว่างประเทศมีหน้าที่รับผิดชอบในการจัดเตรียมเอกสารการเดินทางที่จำเป็นทั้งหมดรวมถึงวีซ่า เพื่อให้เป็นไปตามกฎหมายของแต่ละประเทศที่เดินทางออก ,ประเทศที่เดินทางผ่าน และประเทศปลายทาง</p><p>๑๓.๒.๒ ข้อกำหนดเอกสารการเดินทางภายในประเทศ</p><p>ผู้โดยสารต้องแสดงหนังสือเดินทาง (พาสปอร์ต) บัตรประจำตัวประชาชนไทย หรือเอกสารที่ออกให้โดยหน่วยงานราชการไทยและมีรูปถ่าย เช่น บัตรประจำตัวข้าราชการ ใบอนุญาตขับขี่ หรือแบบรับรองรายการทะเบียนราษฎร ต่อพนักงานที่เคาน์เตอร์เช็คอินและขณะขึ้นเครื่อง</p><p>ทารกและเด็กสัญชาติไทยสามารถแสดงหนังสือเดินทาง (พาสปอร์ต) หรือบัตรประชาชน หรือสูติบัตรฉบับจริงได้</p><p>ผู้โดยสารที่ไม่มีสัญชาติไทยจำเป็นต้องแสดงหนังสือเดินทาง (พาสปอร์ต) หรือเอกสารแสดงตนที่ออกโดยหน่วยงานราชการไทยและมีรูปถ่าย ได้แก่</p><p>• บัตรประจำตัวคนซึ่งไม่มีสัญชาติไทย</p><p>โดยสามารถใช้ในการเดินทางภายในประเทศไทยเท่านั้น</p><p>หมายเหตุ : สำเนาเอกสารแสดงตน ไม่สามารถใช้เป็นเอกสารแสดงตนในการเดินทางได้</p><p><span class="text-big">๑๓.๓ การปฏิเสธการเดินทางเข้า</span></p><p>หากผู้โดยสารได้รับการปฏิเสธการเดินทางเข้าไปยังประเทศใด ๆ ผู้โดยสารจะต้องรับผิดชอบในการชำระเงินค่าปรับ และค่าธรรมเนียมใด ๆ ตามที่รัฐบาลของประเทศนั้น ๆ มีการประเมินและเรียกเก็บจากสายการบิน และสำหรับค่าใช้จ่ายการเดินทางของผู้โดยสารจากประเทศนั้น ๆ ทั้งนี้ สายการบินจะไม่คืนเงินค่าบัตรโดยสารที่เก็บสำหรับการเดินทางโดยอากาศยานจากจุดที่ผู้โดยสารได้รับการปฏิเสธ หรือการเข้าเมืองของผู้โดยสารถูกปฏิเสธแต่อย่างใด</p><p><span class="text-big">๑๓.๔ ผู้โดยสารที่ต้องรับผิดชอบต่อค่าปรับ ค่าใช้จ่ายที่เกิดขึ้นจากการกักตัว และอื่น ๆ</span></p><p>หากมีการเรียกเก็บเงินค่าปรับ รวมถึงค่าเสียหายทางแพ่งตามที่เป็นการกำหนดบทลงโทษ หรือมีค่าใช้จ่ายใด ๆ เกิดขึ้น โดยเหตุจากความล้มเหลวในการปฏิบัติตามกฎหมาย ระเบียบปฏิบัติ คำสั่งการ คำร้อง หรือความประสงค์ ข้อกำหนดเกี่ยวกับการเดินทางของบรรดาประเทศที่เกี่ยวข้อง หรือการดำเนินการจัดหาเอกสารต่างที่กำหนด ผู้โดยสารจะต้องรับผิดชอบในการชำระค่าใช้จ่ายดังกล่าวคืนให้กับสายการบิน ตามการเรียกร้อง เป็นไปตามจำนวนเงินที่มีชำระ หรือค่าใช้จ่ายต่าง ๆ ที่เกิดขึ้น โดยที่สายการบินอาจจะนำมาพิจารณาร่วมกับจำนวนเงินที่ทีมีการชำระ หรือค่าใช้จ่ายใด ๆ ตามมูลค่าของการเดินทางโดยอากาศยานตามบัตรโดยสารของผู้โดยสาร ที่ยังมิได้ใช้งานจริง หรือส่วนใด ๆ ของเงินของผู้โดยสารที่สายการบินถือครองไว้</p><p><span class="text-big">๑๓.๕ การตรวจสอบทางศุลกากร</span></p><p>หากจำเป็น หรือตามการร้องขอ ผู้โดยสารจะต้องเข้ารับการตรวจสอบกระเป๋าสัมภาระของผู้โดยสาร ในพิธีการด้านศุลกากร หรือโดยเจ้าหน้าที่รัฐอื่น ๆ โดยสายการบินจะไม่รับผิดต่อผู้โดยสารสำหรับการสูญหาย หรือความเสียหายที่เกิดขึ้น และส่งผลกระทบต่อผู้โดยสาร ในส่วนที่มาจากลักษณะการตรวจสอบ หรือการดำเนินการของผู้โดยสารที่มิได้เป็นไปตามข้อกำหนดเหล่านี้</p><p><span class="text-big">๑๓.๖ การตรวจสอบเพื่อรักษาความปลอดภัย</span></p><p>ผู้โดยสารควรให้ความร่วมมือในการนำส่งการตรวจสอบเพื่อรักษาความปลอดภัย ซึ่งเป็นการดำเนินการโดยรัฐบาล เจ้าหน้าที่สนามบิน สายการบิน หรือโดยสายการบิน</p>

Administrative Formalities

<p>Carriage to be performed by us and other Carriers under one Ticket, or a Conjunction Ticket is regarded as a single operation for the purposes of the Convention. However, your attention is drawn to Article 15.1.2(b).</p>

<h4>16.1 Notice of Claims</h4>

<p>Acceptance of Baggage by the bearer of the Baggage Check Identification Tag without complaint at the time of delivery is sufficient evidence that the Baggage has been delivered in good condition and in accordance with the contract of carriage, unless you prove otherwise.</p>

<p>If you wish to file a claim or an action regarding Damage to Checked Baggage, you must notify us as soon as you discover the Damage, and at the latest, within seven (7) Days of receipt of the Baggage. If you wish to file a claim or an action regarding delay of Checked Baggage, you must notify us within twenty-one (21) Days from the date the Baggage has been placed at your disposal. Any such notification must be made in writing.</p>

<h4>16.2 Limitation of Actions</h4>

<p>Any action in court to claim Damages must be brought within two (2) years from the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived.</p>


<h4>๑๖.๑ การแจ้งการเรียกร้อง</h4>

<p>การรับกระเป๋าสัมภาระโดยผู้ถือบัตรแสดงการตรวจสอบและเก็บกระเป๋าสัมภาระเข้าห้องเก็บสัมภาระของอากาศยาน (baggage check) โดยมิได้มีการแจ้งร้องเรียนใด ๆ ณ เวลาที่มีการนำส่งกระเป๋าสัมภาระนั้น ๆ ให้ถือเป็นหลักฐานที่เพียงพอที่แสดงว่า การนำส่งกระเป๋าสัมภาระนั้น ๆ เป็นไปโดยปกติ โดยกระเป๋าสัมภาระอยู่ในสภาพที่ดี และเป็นไปตามสัญญาของการขนส่ง เว้นแต่ผู้โดยสารจะสามารถพิสูจน์ได้เป็นอื่นใด</p>

<p>หากผู้โดยสารประสงค์จะยื่นข้อเรียกร้องหรือการดำเนินการร้องเรียนใด ๆ เกี่ยวกับความเสียหายที่เกิดขึ้นกับกระเป๋าที่ผ่านการตรวจสอบและเก็บเข้าห้องเก็บสัมภาระของอากาศยาน (checked baggage) ผู้โดยสารจะต้องแจ้งให้สายการบินได้ทราบโดยทันที หลังจากที่ผู้โดยสารตรวจพบความเสียหายนั้น ๆ และอย่างน้อยที่สุด ภายในระยะเวลาเจ็ด (๗) วันหลังจากที่ได้รับกระเป๋าสัมภาระดังกล่าว หากผู้โดยสารประสงค์จะยื่นข้อเรียกร้อง หรือการดำเนินการร้องเรียนใด ๆ เกี่ยวกับความล้าช้าของกระเป๋าที่ผ่านการตรวจสอบและเก็บเข้าห้องเก็บสัมภาระของอากาศยาน (checked baggage) ผู้โดยสารจะต้องแจ้งให้สายการบินได้ทราบภายในยี่สิบเอ็ด (๒๑) วันนับจากวันที่มีการนำส่งกระเป๋าสัมภาระให้ไว้กับสถานที่ของผู้โดยสาร โดยการแจ้งใด ๆ จะต้องดำเนินการเป็นลายลักษณ์อักษรเท่านั้น</p>

<h4>๑๖.๒ ข้อจำกัดในการดำเนินการต่าง ๆ</h4>

<p>การดำเนินการฟ้องร้อง หรือเรียกร้องใด ๆ ในศาลยุติธรรมเพื่อเรียกร้องเกี่ยวกับความเสียหายจะต้องดำเนินการภายในระยะเวลาสอง (๒) ปี นับจากวันที่อากาศยานนั้น ๆ เดินทางเข้าถึงจุดเป้าหมาย หรือจากวันที่อากาศยานนั้น ๆ คาดการณ์ หรือควรจะเดินทางเข้าถึงแล้ว</p>

<p>Bangkok Airways Contingency Plan for Lengthy Tarmac Delays</p>

<p>In the event of a lengthy tarmac delay affecting any of our flights that depart from or arrive at an airport in China, the contingency plan is as follows:</p>

<ol>
	<li>Beginning 30 minutes after the scheduled departure and every thirty minutes thereafter: Information shall be provided to delayed Passengers regarding the reason for the delay and the status of the delay, if known.</li>
	<li>Delay exceeding 2 hours (including 2 hours): Adequate food and water for Passengers shall be provided.</li>
	<li>Delay exceeding 3 hours (including 3 hours) and there is no definite takeoff time: Disembarkation shall be arranged as long as safety and security regulations are strictly followed.</li>
	<li>Operable lavatory facilities shall be provided while the aircraft remains on the tarmac during the period of delay.</li>
	<li>Adequate medical attention shall be provided if needed while the aircraft remains on the tarmac during the period of delay.</li>
</ol>

<p>In the event of a tarmac delay, airport and ground handling agents shall assist the Carrier in providing the related services.</p>

<p>6.1 Check-in Deadlines are different at every airport. We recommend that you inform yourself of those Check-in Deadlines. Your journey will be smoother if you allow yourself ample time to comply with the Check-in Deadlines. We reserve the right to cancel your reservation if you do not comply with the Check-in Deadlines indicated. We or our Authorized Agents will advise you of the Check-in Deadline for your first flight with us. For any subsequent flights in your journey, you are responsible for informing yourself of the Check-in Deadlines. Check-in Deadlines for our flights can be found in our timetable, or may be obtained from us or our Authorized Agents.</p>

<p>6.2 You must be present at the boarding gate not later than the time as notified by us when you check-in.</p>

<p>6.3 We may cancel the seat reserved for you if you fail to arrive at the boarding gate in time.</p>

<p>6.4 We will not be liable to you for any loss or expense incurred due to your failure to comply with the provisions of this Article, subject to the terms and restrictions of your Ticket.</p>

<p>๖.๒ ผู้โดยสารจะต้องเข้าถึง และอยู่ในบริเวณประตูทางออกสำหรับการขึ้นอากาศยาน ไม่เกินกว่ากำหนดระยะเวลาที่สายการบินกำหนด ซึ่งจะแจ้งให้ผู้โดยสารทราบในช่วงที่ดำเนินการเช็คอิน</p>

<p>๖.๓ สายการบินอาจจะขอยกเลิกที่นั่งซึ่งทำการสำรองไว้ให้กับผู้โดยสาร หากผู้โดยสารไม่สามารถเข้าถึงและอยู่ในบริเวณประตูทางออกสำหรับการขึ้นอากาศยานตามระยะเวลาที่สายการบินกำหนดไว้ได้</p>

<p>๖.๔ สายการบินจะไม่รับผิดใด ๆ ต่อผู้โดยสาร ในกรณีที่มีความสูญเสีย หรือมีค่าใช้จ่ายใด ๆ เกิดขึ้น เนื่องจากความผิดพลาดที่เกิดจากผู้โดยสาร ซึ่งไม่ได้ดำเนินการตามบทบัญญัติในข้อนี้ ทั้งนี้ ให้เป็นไปตามเงื่อนไขและข้อกำหนดของบัตรโดยสารนั้น</p>

<p>12.1 If we make arrangements for you with any third party to provide any services other than carriage by air, or if we issue a Ticket or voucher relating to transportation or services (other than carriage by air) provided by a third party, such as hotel reservations or car rental, in doing so, we act only as your agent. The terms and conditions of the third party service provider will apply.</p>

<p>12.2 If we are also providing other modes of transportation to you (e.g. by land or sea), other conditions may apply to such service. Such conditions will be provided upon your request.</p>

Arrangements For Additional Services

<h4>2.1 General</h4>

<p>Except as provided in Articles 2.2, 2.4 and 2.5, our Conditions of Carriage apply only on those flights, or flight segments, where our name or Airline Designator Code is indicated in the Carrier box of the Ticket for that flight or flight segment.</p>

<h4>2.2 Charter Operations</h4>

<p>If carriage is conducted in accordance with a charter agreement, these Conditions of Carriage apply only to the extent they are incorporated by reference or otherwise, in the charter agreement or the Ticket.</p>

<h4>2.3 Code Shares</h4>

<p>In the case where we have arrangements with other Carriers, also known as &ldquo;Code Shares&rdquo;, this means that even if you have a reservation with usand hold a Ticket where our name or Airline Designator Code is indicated as the Carrier, another Carrier may operate the aircraft. If such arrangements apply, we will advise you of the Carrier operating the aircraft at the time you make a reservation.</p>

<h4>2.4 Overriding Law</h4>

<p>These Conditions of Carriage shall apply, unless otherwise inconsistent with our Tariffs or the applicable laws, in which event such Tariffs or laws shall prevail.</p>

<p>If any provision under these Conditions of Carriage is inconsistent with or in violation of any applicable law, the other provisions shall nevertheless remain in full force and effect.</p>

<h4>2.5 Conditions Prevail Over Regulations</h4>

<p>Except as provided in these Conditions of Carriage, in the event of any inconsistency between these Conditions of Carriage and any of our other regulations, in dealing with particular subjects, the provisions of these Conditions of Carriage shall prevail.</p>

<p>ให้นำเงื่อนไขของการขนส่งเหล่านี้มาใช้เป็นการทั่วไป เว้นแต่บทบัญญัติที่มีอยู่มิได้สอดคล้องกับค่าธรรมเนียมของสายการบิน หรือกฎหมายต่าง ๆ ที่เกี่ยวข้อง ซึ่งเหตุการณ์นั้น ๆ ถือเอาค่าธรรมเนียม และกฎหมายนั้น ๆ มาใช้เป็นสำคัญ</p>

<p>หากมีบทบัญญัติใด ๆ ในเงื่อนไขของการขนส่งเหล่านี้ที่ไม่สอดคล้อง หรือถูกต้องตามกฎหมายต่าง ๆ ที่เกี่ยวข้อง ให้ถือว่าบทบัญญัติในข้ออื่น ๆ ยังคงมีผลบังคับใช้ได้อยู่</p>

<h4>๒.๕ เงื่อนไขที่มีอำนาจเหนือกว่าระเบียบ ข้อบังคับต่าง ๆ</h4>

Applicability

<h3>9.1 Schedules</h3>

<p>9.1.1 The flight times shown in timetables may change between their date of publication and the date you actually travel due to reasons beyond our control. We do not guarantee the changes to flight times to you and they do not form part of your contract with us.</p>

<p>9.1.2 Before we accept your booking, we will notify you of the scheduled flight time in effect as at that time, which will be shown on your Ticket. It is possible that we may need to change the scheduled flight time subsequent to the issuance of your Ticket. If you provide us with your contact information, we will endeavor to notify you of any such changes. If, after you purchase your Ticket, we make a significant change to the scheduled flight time, which is not acceptable to you, and we are unable to book you on an alternate flight which is acceptable to you, you will be entitled to a refund in accordance with Article 10.2.</p>

<h3>9.2 Cancellation, Rerouting, Delays, Etc.</h3>

<p>9.2.1 We will take all necessary measures to avoid any delay in carrying you and your Baggage. In the case of a delay due to a Force Majeure that is beyond our control, we will arrange for a flight to be operated on our behalf by an alternative Carrier and/or aircraft for you.</p>

<p>9.2.2 Except as otherwise provided by the Convention, if we cancel a flight, fail to operate a flight reasonably according to the schedule, fail to stop at your destination or Stopover destination, or cause you to miss a connecting flight on which you hold a confirmed reservation, we shall take one of the following measures of your choosing:</p>

<p>&nbsp;&nbsp;&nbsp;9.2.2.1 Carry you, at the earliest opportunity, on another of our scheduled services on which space is available without any additional charge and, where necessary, extend the validity of your Ticket; or</p>

<p>&nbsp;&nbsp;&nbsp;9.2.2.2 Within a reasonable period of time, re-route you to the destination shown on your Ticket by our own services or those of another Carrier, or by other mutually agreed means and class of transportation, without additional charge. If the fare and charges for the revised routing are lower than what you have paid, we shall refund the difference; or</p>

<p>&nbsp;&nbsp;&nbsp;9.2.2.3 Make a refund in accordance with the provisions of Article 10.2.</p>

<p>9.2.3 Upon the occurrence of any of the events set out in Article 9.2.2, unless as otherwise provided by the Convention, the options outlined in Articles 9.2.2.1 through 9.2.2.3 are the sole and exclusive remedies available to you and we shall have no further liability to you, notwithstanding the scope of liability of an airline as provided in the International Carriage by Air Act B.E. 2558 (2015).</p>

<p>9.2.4 If we are unable to provide previously confirmed space, we shall provide compensation to those Passengers denied boarding in accordance with applicable laws and our denied boarding compensation policy.</p>

<p>๙.๑.๒ ก่อนที่สายการบินจะยอมรับการสำรองบัตรโดยสารของผู้โดยสาร สายการบินจะแจ้งให้ผู้โดยสารทราบถึงตารางเที่ยวบินที่ใช้อยู่ ณ เวลานั้น ๆ และจะแสดงไว้ในบัตรโดยสารของผู้โดยสาร โดยหากเป็นไปได้ สายการบินอาจจะต้องมีการเปลี่ยนแปลงเวลาเที่ยวบินตามที่กำหนด และเป็นเที่ยวบินตามที่แสดงไว้ในบัตรโดยสารของผู้โดยสารที่ออกไว้ก่อนแล้ว หากผู้โดยสารได้ให้ข้อมูลการติดต่อกลับไว้กับสายการบิน สายการบินจะพยายามแจ้งให้ผู้โดยสารทราบถึงการเปลี่ยนแปลงดังกล่าว โดยหากเป็นช่วงหลังจากที่ผู้โดยสารได้ซื้อบัตรโดยสารของผู้โดยสารแล้ว สายการบินได้มีการเปลี่ยนแปลงใหญ่ ๆ ที่จะส่งผลกระทบต่อตารางเที่ยวบิน ซึ่งผู้โดยสารไม่สามารถยอมรับได้ และสายการบินไม่สามารถจัดหาเที่ยวบินอื่น ๆ ที่ทำให้ผู้โดยสารยอมรับได้ ผู้โดยสารสามารถของรับเงินคืนได้ตามข้อ ๑๐.๒</p>

<h4>๙.๒ การยกเลิก การเปลี่ยนแปลงเส้นทาง ความล่าช้า และอื่น ๆ</h4>

<p>๙.๒.๑ สายการบิน จะดำเนินมาตรการเพื่อหลีกเลี่ยงความล่าช้าและการยกเลิกเที่ยวบิน ซึ่งจะส่งผลกระทบต่อการเดินทางและสัมภาระของผู้โดยสาร หากมีเหตุสุดวิสัย ซึ่งนอกเหนือการควบคุมของสยาการบิน สายการบิน จะจัดเที่ยวบินอื่นหรือการขนส่งทางอื่นให้กับผู้โดยสาร</p>

<p>๙.๒.๒ หากสายการบินทำการยกเลิกเที่ยวบิน หรือไม่สามารถทำการบินอันเหตุเนื่องจากตารางบิน หรือไม่สามารถลงจอด ณ จุดหมายปลายทางของผู้โดยสาร หรือการเข้าจอดแวะพักตามจุดหมายปลายทาง หรือเป็นเหตุให้ผู้โดยสารต้องพลาดการต่อเที่ยวบิน ซึ่งการสำรองที่นั่งของผู้โดยสารได้รับการยืนยันแล้ว สายการบินจะดำเนินการ ตามทางเลือกที่ผู้โดยสารเห็นชอบ ดังนี้ (เว้นแต่มีการกำหนดไว้เป็นอย่างอื่นในอนุสัญญา)</p>

<p>๙.๒.๒.๑ สายการบินจะนำส่งผู้โดยสารให้สามารถเดินทางได้เร็วที่สุดตามตารางบินที่มีอยู่ โดยไม่เรียกเก็บค่าใช้จ่ายใด ๆ เพิ่มเติม และหากจำเป็น สายการบินจะขยายเวลาในการใช้บัตรโดยสารของผู้โดยสาร หรือ</p>

<p>๙.๒.๒.๒ หากเป็นไปได้สายการบินจะนำส่งผู้โดยสาร โดยการเปลี่ยนแปลงเส้นทางการเดินทางของผู้โดยสารไปยังจุดหมายปลายทางที่แสดงไว้ในบัตรโดยสารของผู้โดยสาร โดยสายการบิน หรือการบริการของสายการบินอื่น ๆ หรือโดยวิธีการอื่น ๆ ตามที่เห็นพ้องร่วมกัน และไม่มีการคิดค่าธรรมเนียม หรือค่าใช้จ่ายใด ๆ เพิ่มเติม ทั้งนี้ หากราคาของค่าโดยสารและค่าธรรมเนียมต่าง ๆ ของเส้นทางที่ปรับเปลี่ยนไปนั้น น้อยกว่าจำนวนเงินที่ผู้โดยสารได้ชำระไปแล้ว สายการบินจะคืนเงินส่วนต่างให้กับผู้โดยสาร หรือ</p>

<p>๙.๒.๒.๓ สายการบินจะคืนเงินค่าบัตรโดยสารให้กับผู้โดยสาร โดยเป็นไปตามบทบัญญัติในข้อ ๑๐.๒</p>

<p>๙.๒.๓ หากมีเหตุการณ์อันเกิดตามข้อ ๙.๒.๒ เว้นแต่มีการกำหนดไว้เป็นอย่างอื่นในอนุสัญญา หากเป็นเหตุการณ์ตามข้อ ๙.๒.๒.๑ ถึงข้อ ๙.๒.๒.๓ ผู้โดยสารจะได้รับการเยียวยาตามที่ระบุไว้ และถือว่าสายการบินจะไม่ต้องรับผิดใด ๆ ต่อผู้โดยสารอีกต่อไป</p>

<p>อย่างไรก็ตาม ขอบเขตความรับผิดของสายการบิน จะเป็นไปตาม พ.ร.บ. การรับขนทางอากาศระหว่างประเทศ พ.ศ. 2558</p>

<p>๙.๒.๔ หากสายการบินไม่สามารถจัดหาที่นั่งตามที่ยืนยันให้ก่อนหน้านี้ได้ สายการบินจะจ่ายเงินชดเชยให้กับผู้โดยสารที่ไม่ได้รับอนุญาตให้ขึ้นโดยสารเที่ยวบินดังกล่าว โดยเป็นการปฏิบัติตามกฎหมายข้อบังคับที่เกี่ยวข้อง และนโยบายการจ่ายค่าชดเชยความเสียหายที่เกิดจากการที่ผู้โดยสารไม่ได้รับอนุญาตให้ขึ้นโดยสารในอากาศยาน</p>


Schedules, Delays, Cancellation of Flights

<h4>11.1 General</h4>

<p>If, in our reasonable opinion, you conduct yourself aboard the aircraft so as to endanger the aircraft or any person or property on board, or obstruct the crew in the performance of their duties, or fail to comply with any instructions of the crew including but not limited to those with respect to smoking, alcohol or drug consumption, or behave in a manner which causes discomfort, inconvenience, Damage or injury to other Passengers or the crew, we may take such measures as we deem reasonably necessary to discontinue such conduct, including restraint. You may be disembarked and refused onward carriage at any point, and may be prosecuted for offences committed on board the aircraft.</p>

<h4>11.2 Payment of Diversion Costs</h4>

<p>If, as a result of conduct by you as provided in Article 11.1 above, we decide, in the exercise of our reasonable discretion, to divert the aircraft for the purpose of offloading you, you must pay all costs resulting from that diversion.</p>

<h4>11.3 Electronic Devices</h4>

<p>For safety reasons, we may forbid or limit operation abroad the aircraft of electronic equipment, including, but not limited to, mobile phones, laptop computers, portable recorders, portable radios, CD players, electronic games or transmitting devices, including radio controlled toys and walkie-talkies. Operation of hearing aids and heart pacemakers is permitted.</p>

<p>ในกรณีที่เป็นความเห็นอย่างมีเหตุผลของสายการบิน สายการบินขอดำเนินการต่าง ๆ กับผู้โดยสารบนอากาศยาน ในลักษณะที่เป็นการกระทำใด ๆ ที่จะเป็นอันตรายต่ออากาศยาน หรือต่อบุคคล หรือต่อทรัพย์สินที่อยู่บนอากาศยาน หรือการกระทำที่เป็นการขัดขวางการปฏิบัติงานของพนักงานบริการบนอากาศยาน (ลูกเรือ) หรือการปฏิบัติใด ๆ ที่ไม่เป็นไปตามข้อแนะนำของพนักงานบริการบนอากาศยาน (ลูกเรือ) ซึ่งหมายรวมถึง แต่ไม่จำกัดเฉพาะกับส่วนที่เกี่ยวข้องกับการสูบบุหรี่ การบริโภคเครื่องดื่มอัลกอฮอล์ หรือสิ่งเสพติดต่าง ๆ หรือการมีพฤติกรรมที่สร้างความรำคาญ การก่อกวน การสร้างความเสียหาย หรือการทำให้เกิดการบาดเจ็บต่อผู้โดยสาร หรือพนักงานบริการบนอากาศยาน (ลูกเรือ) สายการบินอาจจะดำเนินมาตรการดังกล่าว ตามที่เห็นสมควร และเป็นความจำเป็นในการป้องปรามพฤติการณ์การกระทำนั้น ๆ รวมถึงการระงับยับยั้งต่าง ๆ ซึ่งอาจจะมานำตัวผู้โดยสารออกจากอากาศยาน และการปฏิเสธการเดินทางต่อบนอากาศยาน ณ จุดใด ๆ และอาจจะมีการดำเนินการเอาผิดตามกฎหมาย ตามการกระทำที่เป็นการฝ่าฝืนกฎหมายเกี่ยวกับการเดินทางบนอากาศยาน</p>

<h4>๑๑.๒ การชำระค่าใช้จ่ายการเปลี่ยนแปลง</h4>

<p>หากเป็นผลมาจากการดำเนินการของผู้โดยสารในส่วนที่บัญญัติไว้ในข้อที่ ๑๑.๑ ตามที่สายการบินได้พิจารณาตัดสิน โดยหลังจากการพิจารณาอย่างถ่องแท้และโดยเหตุผลของสายการบินแล้ว อาจจะกำหนดให้อากาศยานนั้น ๆ บินกลับในเส้นทางเดิมเพื่อให้นำส่งผู้โดยสารออกจากอากาศยาน ซึ่งผู้โดยสารจะต้องชำระค่าใช้จ่ายทั้งหมดที่เกิดขึ้นจากการบินกลับในครั้งนั้น ๆ</p>

<h4>๑๑.๓ อุปกรณ์อิเล็กทรอนิกส์</h4>

<p>เพื่อความปลอดภัย สายการบินอาจจะห้ามหรือควบคุมการดำเนินการเกี่ยวกับการใช้งานอุปกรณ์อิเล็กทรอนิกส์ต่าง ๆ ระหว่างที่มีการเดินทางบนอากาศยาน โดยหมายรวมถึง แต่มิได้จำกัดเฉพาะกับ เครื่องโทรศัพท์เคลื่อนที่ เครื่องคอมพิวเตอร์แบบพกพา เครื่องบันทึกเสียงแบบพกพา เครื่องวิทยุแบบพกพา เครื่องเล่นซีดี เกมส์อิเล็กทรอนิกส์ หรือเครื่องส่งสัญญาณต่าง ๆ รวมถึงเครื่องเล่นที่ควบคุมโดยสัญญาณวิทยุ และเครื่องมือวิทยุสื่อสารต่าง ๆ ทั้งนี้ ในส่วนของอุปกรณ์เครื่องช่วยฟัง และเครื่องกระตุ้นหัวใจยังคงใช้ได้ตามปกติ</p>
