<h2>Bangkok Airways Notice on Passenger Rights</h2>

<p>This notice is issued in accordance with the Regulation of the Civil Aviation Board No. 101, prescribing Measures to Protect Passenger Rights on Domestic and International Scheduled Flights, which enters into force from 20 May 2025. Bangkok Airways, in compliance with its obligations thereunder, is responsible for upholding your rights as a passenger rights and for providing assistance as set forth below.</p>

<h3>Applicability</h3>

<p>This Regulation applies to you if you are traveling on a domestic or international flights departing from the Kingdom of Thailand under the following conditions:</p>

<ul>
	<li>You present yourself for check-in at the <a href="https://www.bangkokair.com/airport-check-in" target="_blank">time specified by Bangkok Airways</a>. In the absence of a specified time, you must present yourself for check-in no later than 45 minutes prior to the departure time for domestic flights or 1 hour prior to the scheduled departure time for international flights; or</li>
	<li>You present yourself for check-in at a time other than specified above and are nevertheless accepted for carriage by Bangkok Airways; or</li>
	<li>You have been transferred from your reserved flight to another flight for any reason; or</li>
	<li>Your reserved flight has been rescheduled to depart more than 5 hours different from the time specified in the published schedule; or</li>
	<li>Your reserved flight has been canceled.</li>
</ul>

<h3>Delay</h3>

<p>If your flight is expected to be delayed by more than 2 hours, you are entitled to receive a meal, refreshments, and access to communication facilities.</p>

<p>For international flights delayed by more than 5 hours, you are entitled to at least 1 night of hotel accommodation including transportation costs if necessary.</p>

<p>If the delay of more than 2 hours for domestic flights or more than 5 hours for international flights results in your flight no longer serving its intended purpose, you have the right to cancel your journey and receive a fund for the part or parts of the journey not undertaken.</p>

<p>Unless the delay is caused by extraordinary circumstances, you are entitled to compensation. You may choose to receive compensation either in cash or in the form of a travel voucher based on the following conditions:</p>

<ul>
	<li>THB 1,200 for domestic flights delayed by more than 5 hours;</li>
	<li>THB 1,500 for international flights delayed by more than 5 hours;</li>
	<li>THB 2,000 for international flights delayed by more than 10 hours with a distance of 1,500 kilometers or less;</li>
	<li>THB 3,500 for international flights delayed by more than 10 hours with a distance greater than 1,500 kilometers but not exceeding 3,500 kilometers;</li>
	<li>THB 4,500 for international flights delayed by more than 10 hours with a distance greater than 3,500 kilometers.</li>
</ul>

<h3>Cancellation</h3>

<p>If your flight is canceled, you are entitled to the following:</p>

<ul>
	<li>Care: You are entitled to receive meals and refreshments, access to communication facilities, and at least 1 night of hotel accommodation including transportation costs, if required.</li>
	<li>Options: You have the right to choose between reimbursement of the ticket for the part or parts of the journey not undertaken, re-routing to your final destination or travel by alternative means of transport.</li>
	<li>Compensation: Unless the cancellation falls within the circumstances of ineligibility, including where it is caused by extraordinary circumstances, you are entitled to receive compensation.</li>
</ul>

<p><u>Compensation Amounts</u></p>

<ul>
	<li>THB 1,500 for domestic flights;</li>
	<li>THB 2,000 for international flights with a distance of 1,500 kilometers or less;</li>
	<li>THB 3,500 for international flights with a distance greater than 1,500 kilometers but not exceeding 3,500 kilometers.</li>
	<li>THB 4,500 for international flights with a distance greater than 3,500 kilometers.</li>
</ul>

<p><u>You are not entitled to receive compensation if</u></p>

<ul>
	<li>You are informed of the cancellation and provided with alternative travel options at least 3 days prior to the scheduled departure for domestic flights, or at least 7days prior to the scheduled departure for international flights.</li>
	<li>You are informed of the cancellation less than the specified timeframes above, but the alternative flight departs for the same destination within a reasonable period before or after the original departure time and arrives at the destination no more than 3 hours earlier or later than the original scheduled arrival time.</li>
	<li>The cancellation is caused by extraordinary circumstances.</li>
</ul>

<h3>Denied Boarding</h3>

<p>When the number of passengers exceeds the available seats on a flight, Bangkok Airways may call for volunteers to relinquish their seats in exchange for compensation and/or other agreed-upon benefits.</p>

<p>If you volunteer or are involuntarily denied boarding, you are entitled to receive the same care, options, and compensation as in the case of a flight cancellation.</p>

<p>However, you are not entitled to these rights if you are denied boarding for reasonable grounds, including reasons related to health, safety, security, or inadequate travel documentation.</p>

<h3>Downgrading</h3>

<p>If you are involuntarily assigned to a lower class than what is specified on your purchased ticket, you are entitled to a reimbursement based on the following criteria:</p>

<ul>
	<li>30% of the ticket price for flights with a distance of 1,500 kilometers or less;</li>
	<li>50% of the ticket price for flights with a distance greater than 1,500 kilometers &ndash; 3,500 kilometers; or</li>
	<li>75% of the ticket price for flights with a distance greater than 3,500 kilometers.</li>
</ul>

<p>In all cases, reimbursement will be processed using the same payment method that you used to purchase by the ticket, such as cash, bank transfer, or credit card. Reimbursement will be completed within the following timeframes, calculated from the date Bangkok Airways or the travel agent receives the reimbursement form and all required documents:</p>

<ul>
	<li>If you purchased the ticket with cash, reimbursement will be completed within 14 days;</li>
	<li>If you purchased the ticket with a credit card, reimbursement will be completed within 45 days;</li>
	<li>If you select to accept reimburse in the form of a travel voucher, reimbursement will be completed within 7 days;</li>
	<li>If you purchased the ticket through a travel agent, reimbursement will be completed within 60 days by the travel agent.</li>
</ul>

<p>You have the right to receive compensation for any damages incurred in accordance with <a href="https://www.bangkokair.com/conditions/conditions-of-carriage" target="_blank">Bangkok Airways&#39; Conditions of Carriage</a>.</p>

<p>If you experience a situation described in this Notice and believe that Bangkok Airways has not complied with its obligation, you are encouraged to contact Bangkok Airways Customer Relations after the completion of your journey. <h2>ประกาศเกี่ยวกับสิทธิผู้โดยสารของสายการบินบางกอกแอร์เวย์ส</h2>

<p>ประกาศฉบับนี้ได้ออกตามข้อบังคับของคณะกรรมการการบินพลเรือน ฉบับที่ 101 ซึ่งกำหนดเรื่อง มาตรการคุ้มครองสิทธิของผู้โดยสารในเที่ยวบินแบบประจำภายในประเทศและระหว่างประเทศ มีผลใช้บังคับตั้งแต่วันที่ 20 พฤษภาคม 2568 เป็นต้นไป โดยสายการบินบางกอกแอร์เวย์ส (&ldquo;สายการบิน&rdquo;) มีความรับผิดชอบในการคุ้มครองสิทธิผู้โดยสาร รวมทั้งให้ความช่วยเหลือตามที่กำหนดดังต่อไปนี้</p>

<h3>การมีผลบังคับใช้</h3>

<p>ข้อบังคับฉบับนี้มีผลใช้กับผู้โดยสารที่เดินทางด้วยเที่ยวบินภายในประเทศหรือระหว่างประเทศซึ่งออกจากราชอาณาจักรไทยภายใต้เงื่อนไขต่อไปนี้</p>

<ul>
	<li>ผู้โดยสารต้องแสดงตนเพื่อเช็กอิน ตาม<a href="https://www.bangkokair.com/airport-check-in" target="_blank">เวลาที่สายการบินกำหนด</a> หากไม่มีการกำหนดเวลาไว้ ผู้โดยสารต้องมาติดต่อเช็กอินไม่ช้ากว่า 45 นาที ก่อนเวลาออกเดินทางสำหรับเที่ยวบินภายในประเทศ และไม่ช้ากว่า 1 ชั่วโมงก่อนเวลาออกเดินทางไว้สำหรับเที่ยวบินระหว่างประเทศ</li>
	<li>ผู้โดยสารแสดงตนเพื่อเช็กอิน ในเวลาอื่นนอกเหนือจากที่ระบุไว้ข้างต้น แต่สายการบินยอมรับผู้โดยสารให้เดินทางได้</li>
	<li>ผู้โดยสารถูกโอนย้ายจากเที่ยวบินที่สำรองไว้เป็นเที่ยวบินอื่น ไม่ว่าด้วยเหตุใดก็ตาม</li>
	<li>เที่ยวบินที่ผู้โดยสารทำการสำรองไว้มีการปรับเปลี่ยนเวลาออกเดินทางใหม่ โดยเกินกว่า 5 ชั่วโมงจากกำหนดเวลาที่ระบุไว้ในตารางบินที่ได้ประกาศไว้</li>
	<li>เที่ยวบินที่ผู้โดยสารสำรองไว้ถูกยกเลิก</li>
</ul>

<h3>เที่ยวบินล่าช้า</h3>

<p>หากเที่ยวบินของผู้โดยสารคาดว่าจะล่าช้ามากกว่า 2 ชั่วโมง ผู้โดยสารมีสิทธิได้รับอาหาร เครื่องดื่ม และการเข้าถึงช่องทางสื่อสาร</p>

<p>สำหรับเที่ยวบินระหว่างประเทศที่ล่าช้ามากกว่า 5 ชั่วโมง ผู้โดยสารมีสิทธิได้รับที่พักในโรงแรมอย่างน้อย 1 คืน พร้อมค่าขนส่งที่จำเป็น</p>

<p>หากการล่าช้าดังกล่าว (มากกว่า 2 ชั่วโมง สำหรับเที่ยวบินภายในประเทศ หรือมากกว่า 5 ชั่วโมง สำหรับเที่ยวบินระหว่างประเทศ) ส่งผลให้เที่ยวบินดังกล่าวไม่สามารถตอบสนองวัตถุประสงค์ของการเดินทางได้อีกต่อไป ผู้โดยสารมีสิทธิที่จะยกเลิกการเดินทางและขอคืนเงินสำหรับส่วนของการเดินทางที่ยังไม่ได้เดินทาง</p>

<p>ในกรณีที่การล่าช้ามิได้เกิดจากสถานการณ์พิเศษ ผู้โดยสารมีสิทธิได้รับค่าชดเชย ซึ่งสามารถเลือกเป็นเงินสดหรือบัตรกำนัลเดินทาง (Travel Voucher) โดยมีรายละเอียดดังนี้:</p>

<ul>
	<li>1,200 บาทสำหรับเที่ยวบินภายในประเทศที่ล่าช้ามากกว่า 5 ชั่วโมง</li>
	<li>1,500 บาทสำหรับเที่ยวบินระหว่างประเทศที่ล่าช้ามากกว่า 5 ชั่วโมง</li>
	<li>2,000 บาทสำหรับเที่ยวบินระหว่างประเทศที่ล่าช้ามากกว่า 10 ชั่วโมง ที่มีระยะทางไม่เกิน 1,500 กิโลเมตร</li>
	<li>3,500 บาทสำหรับเที่ยวบินระหว่างประเทศล่าช้าเกิน 10 ชั่วโมง ที่มีระยะทางเกินกว่า 1,500 กิโลเมตร ถึง 3,500 กิโลเมตร</li>
	<li>4,500 บาท สำหรับเที่ยวบินระหว่างประเทศที่ล่าช้ามากกว่า 10 ชั่วโมง ที่มีระยะทางมากกว่า 3,500 กิโลเมตร</li>
</ul>

<h3>เที่ยวบินถูกยกเลิก</h3>

<p>หากเที่ยวบินถูกยกเลิก ผู้โดยสารมีสิทธิได้รับ</p>

<ul>
	<li>การดูแล : อาหารเครื่องดื่ม การเข้าถึงช่องทางการสื่อสาร และที่พักในโรงแรมอย่างน้อย 1 คืน พร้อมค่าขนส่งที่จำเป็น</li>
	<li>ทางเลือก : เลือกระหว่างการขอคืนเงินสำหรับส่วนของการเดินทางที่ยังไม่ได้เดินทาง การเปลี่ยนเส้นทางสู่จุดหมายปลายทางสุดท้าย หรือการเดินทางด้วยวิธีการอื่นที่เทียบเท่า</li>
	<li>ค่าชดเชย : ผู้โดยสารจะได้รับค่าชดเชย ยกเว้นกรณีเที่ยวบินถูกยกเลิกจากสถานการณ์พิเศษ หรือเหตุการณ์อื่นใดที่ส่งผลให้ไม่สามารถปฏิบัติการบินได้</li>
</ul>

<p><u>ผู้โดยสารมีสิทธิได้รับค่าชดเชยตามอัตราต่อไปนี้</u></p>

<ul>
	<li>1,500 บาทสำหรับเที่ยวบินภายในประเทศ</li>
	<li>2,000 บาทสำหรับเที่ยวบินระหว่างประเทศที่มีระยะทางไม่เกิน 1,500 กิโลเมตร</li>
	<li>3,500 บาทสำหรับเที่ยวบินระหว่างประเทศที่มีระยะทางเกินกว่า 1,500 กิโลเมตรแต่ไม่เกิน 3,500 กิโลเมตร</li>
	<li>4,500 บาท สำหรับเที่ยวบินระหว่างประเทศที่มีระยะทางมากกว่า 3,500 กิโลเมตร</li>
</ul>

<p><u>ผู้โดยสารไม่มีสิทธิได้รับค่าชดเชยหาก</u></p>

<ul>
	<li>ผู้โดยสารได้รับแจ้งการยกเลิกเที่ยวบินและได้รับการจัดหาทางเลือกอื่นอย่างน้อย 3 วันล่วงหน้าสำหรับเที่ยวบินภายในประเทศหรืออย่างน้อย 7 วันล่วงหน้าสำหรับเที่ยวบินระหว่างประเทศ</li>
	<li>ผู้โดยสารได้รับแจ้งการยกเลิกเที่ยวบินน้อยกว่าที่ระบุข้างต้น แต่เที่ยวบินใหม่ออกเดินทางในช่วงเวลาใกล้เคียงกับเที่ยวบินเดิมและถึงที่หมายไม่เกิน 3 ชั่วโมงก่อนหรือ หลังจากเวลาถึงที่กำหนดไว้</li>
	<li>การยกเลิกเกิดจากสถานการณ์พิเศษ</li>
</ul>

<h3>การถูกปฏิเสธการขึ้นเครื่อง</h3>

<p>หากจำนวนผู้โดยสารเกินกว่าจำนวนที่นั่งที่มีในเที่ยวบิน สายการบินอาจขออาสาสมัครสละที่นั่งโดยเสนอค่าชดเชยและ/หรือสิทธิประโยชน์อื่นที่ตกลงกัน</p>

<p>หากผู้โดยสารเป็นอาสาสมัครหรือถูกปฏิเสธการขึ้นเครื่องโดยไม่สมัครใจ ผู้โดยสารมีสิทธิได้รับการดูแล ทางเลือกและค่าชดเชยเช่นเดียวกับกรณียกเลิกเที่ยวบิน</p>

<p>อย่างไรก็ตาม ผู้โดยสารไม่มีสิทธิได้รับสิทธิเหล่านี้หากผู้โดยสารถูกปฏิเสธการขึ้นเครื่องด้วยเหตุผลอันสมควร เช่น ด้านสุขภาพ ความปลอดภัย หรือเอกสารการเดินทางไม่ถูกต้องเพียงพอ</p>

<h3>การลดชั้นบริการ</h3>

<p>หากผู้โดยสารถูกจัดให้นั่งอยู่ในชั้นบริการที่ต่ำกว่าชั้นที่ระบุในบัตรโดยสารโดยไม่สมัครใจ ผู้โดยสารมีสิทธิได้รับเงินคืนตามอัตราดังนี้:</p>

<ul>
	<li>30% ของราคาบัตรโดยสาร สำหรับเที่ยวบินที่มีระยะทางไม่เกิน 1,500 กิโลเมตร</li>
	<li>50% ของราคาบัตรโดยสารสำหรับเที่ยวบินที่มีระยะทางมากกว่า 1,500 กิโลเมตร แต่ไม่เกิน 3,500 กิโลเมตร</li>
	<li>75% ของราคาบัตรโดยสาร สำหรับเที่ยวบินที่มีระยะทางมากกว่า 3,500 กิโลเมตร</li>
</ul>

<p>การคืนเงินจะดำเนินการผ่านช่องทางเดียวกับที่ผู้โดยสารใช้ชำระเงินค่าบัตรโดยสาร เช่น เงินสด โอนเงินผ่านธนาคาร หรือบัตรเครดิต ภายในระยะเวลาดังต่อไปนี้ (นับจากวันที่สายการหรือบริษัทตัวแทนจำหน่ายได้รับแบบฟอร์มขอคืนเงินพร้อมเอกสารที่เกี่ยวข้องครบถ้วน)</p>

<ul>
	<li>กรณีชำระด้วยเงินสด: ภายใน 14 วัน</li>
	<li>กรณีชำระด้วยบัตรเครดิต: ภายใน 45 วัน</li>
	<li>กรณีเลือกเป็นบัตรกำนัลเดินทาง: ภายใน 7 วัน</li>
	<li>กรณีซื้อบัตรโดยสารผ่านตัวแทนจำหน่าย: ตัวแทนจะคืนเงินภายใน 60 วัน</li>
</ul>

<p>ผู้โดยสารมีสิทธิได้รับค่าชดเชยตาม<a href="https://www.bangkokair.com/conditions/conditions-of-carriage" target="_blank">เงื่อนไขการบินของสายการบิน</a></p>

<p>หากผู้โดยสารพบประสบเหตุการณ์ที่ตามประกาศฉบับนี้และเห็นว่าสายการบินไม่ได้ปฏิบัติตามข้อผูกพัน ผู้โดยสารสามารถติดต่อฝ่ายลูกค้าสัมพันธ์ของบางกอกแอร์เวย์สหลังสิ้นสุดการเดินทาง โดยสามารถค้นหาช่องทางการติดต่อและแบบฟอร์มติดต่อได้ที่ <a href="https://www.bangkokair.com/feedback" target="_blank">https://www.bangkokair.com/feedback</a>.</p>

<p>หากไม่สามารถตกลงกันได้กับฝ่ายลูกค้าสัมพันธ์ ผู้โดยสารสามารถยื่นเรื่องร้องเรียนพร้อมหลักฐานที่เกี่ยวข้องผ่านระบบบริหารจัดการเรื่องร้องเรียนของสำนักงานการบินพลเรือนแห่งประเทศไทย (กพท.) ได้ที่ <a href="https://complaint.caat.or.th" target="_blank">https://complaint.caat.or.th</a>.</p>
