Bangkok Airways Public Company Limited, ("the Company"), is aware of the importance of personal data protection for all personnel, thus considered as appropriate to prepare Personnel Privacy Notice to inform you in details regarding data processing (collection, use or disclosure of personal data) and your rights as Data Subject as follows:

1. TYPE OF DATA SUBJECT

Types of Data Subject whose personal data is collected, used or disclosed by the Company are as follows: Candidate for employment, Employee, Director, Advisor, Outsourced employee and Student trainee including Persons related to the personnel such as family members, companions, contact person in an emergency, reference person, beneficiaries, and guarantors.

2. TYPE OF PERSONAL DATA COLLECTED

the Company may collect your personal data or sensitive personal data to support consideration of employment, human resources management and compliance with employment contracts as follows:

2.1 General Personal Data
Type of Personal Data Details
Basic data such as first name, last name, birth date, age, gender, weight, height, ID number, photograph, signature, nationality, marital status, military status and family member details.
Contact data such as address, telephone number, e-mail and details of contact person in an emergency and reference person.
Education and training data such as academic and training records, certificate of qualification, and transcript.
Data for job application such as personal profile, work experience, resume/CV, evidence or reference documents and details as appeared Assessment of interview form.
Evidence for job application or execution of juristic acts such as copy of ID card, passport, name change certificate, house registration booklet, military service certificate, TOEIC Score, bank book, marriage certificate, birth certificate, beneficiary specification form, social security registration form, employment contract and letter of guarantee.
Work and assessment data such as work permit, performance assessment, achievement and/or award received, training details, disciplinary action details, letter of resignation and reason for the resignation.
Benefit and remuneration data such as salary, wages, compensation, welfare, bank account number, guarantor and beneficiary details, details relating to social security, provident fund, tax and tax reduction, health benefits (including benefits family members), letter of consent for salary deduction.
Work statistics data such as start date, end of probation date, days and time of work, total working hours and overtime working hours, annual leave, leave form with date and details of leave including reasons for taking leave, clock-in and clock-out record.
Technical data such as a log file, IP Address and Mac Address.
Data for reporting to regulatory agencies Such as Ministry of Labor, the Stock Exchange of Thailand, the Securities and Exchange Commission (SEC), Thai Institute of Directors Association (IOD)
Other data such as sound recording of conversations and video recording by means of CCTV.
2.2 Sensitive Personal Data
Type of Sensitive Personal Data Details
Health data such as congenital disease, physical examination results, medical certificate, medical record, medical bills for labor protection purposes, provision of medical care, work capability assessment, compliance with related laws, study and analysis of health information for appropriate management.
Criminal record data such as for consideration of performance suitability and compliance with airport regulations and related laws.
Other data for lawful purposes such as to prevent or arrest any danger to one's life, body or health if the employee is unable to give consent. The information is disclosed to the public with your express consent, to exercise legal claims and to achieve the objectives of labor protection, social security and employee benefits.
Religious data to support ordination leave or leave to perform Haji according to Employees rules and regulations.

3. Sources of Personal Data

3.1 The Company receives personal data directly from you

From recruitment process including information and updated information from employment or other processes during your time as an employee or personnel of the Company.

3.2 The Company receives personal data from third parties

The Company may collect your personal data from other sources such as job application website of third party, government agency, educational institution, social media or job application form and/or documents of persons related to you, contact persons in case of emergency, reference person, beneficiary or guarantor of such person etc.

4. Purposes and lawful basis for data processing

The Company collects, uses or discloses your personal data or sensitive personal data for purposes under lawful basis as follows;

4.1 Necessary for compliance with contracts
  • Preparation of employment contracts, agreements; compliance with employment contract; compliance with the Company rules and regulations and Personnel management rules; Code of business conduct.
  • Assignment of duties, transfer of employees
  • Training, appraisal of performance
  • Consideration of positions and compensation, administration and management of health and safety of employees
4.2 Compliance with legal obligation
  • Compliance with Labor protection law; Labor relations law; Social security law; Safety, occupation, health, and working environment law; Control of occupational disease and environmental disease law; Control of contagious disease law
4.3 Necessary for legitimate interests
  • Human resources management; study, analysis and allocation of manpower; employee development
  • Provision of medical welfare, insurance welfare, and other welfare
  • Conducting employee activities
  • Submitting information to government agencies or regulatory agencies; identification and verification of information provided by employees
  • Providing facilities; maintaining information security; creating user accounts; identification to access working systems and access to information systems
  • Maintain safety and security; prevention of accidents and crimes
  • Checks and management of complaints, frauds, lawsuits and various disputes
  • Taking care of employees after termination of employment or retirement
4.4 Necessary to protect or suppress danger to life, body and health of employees or other persons
  • Make contact in an emergency
  • Control and prevention of contagious disease.
4.5 With your consent
  • Verification of eligibility and suitability for employment, such as health information, criminal record
  • Marketing, such as presenting or appearing as part of the Company's advertising media

5. DISCLOSURE OF PERSONAL DATA

The Company may need to disclose your personal data to support human resources management and other purposes stated above to the following entities and persons:

5.1 Government agencies and Law enforcement agencies

such as Revenue Department, Social Security Office, Department of Labor Protection and Welfare, Legal Execution Department, Student Loan Fund, Department of Skill Development, Department of Empowerment of Persons with Disabilities, the Stock Exchange of Thailand, the Securities and Exchange Commission (SEC).

5.2 Service providers, business partners and data processors

such as HRIS provider, Provident Fund, commercial banks, service providers for health insurance, accidental insurance, training, booking flights and accommodation, external auditor, company advisor.

5.3 Subsidiary and Associated Companies

to propose a suitable position.

5.4 Organizations or third parties

such as to apply for a loan, to use credit services or to apply for a job, in which case the Company will only confirm your status as an employee and disclose other information which you have already disclosed to such organizations or third parties.

6. Personal Data Retention

The Company shall retain your personal data for a period as necessary to achieve the purposes described in this notice and expects to retain personal data according to following period of time.

6.1 Unsuccessful job applicants

we will retain your information for a period of 1 year from date when the results are known to enable the Company to contact you in case some positions are available in the future that may be suitable for you.

6.2 Employees

the Company will retain your information for a period of 10 years from date of termination of employment in the Company, in order to prove or verify cases that may arise within the statute of limitations.

6.3 Other personnel

the Company will retain your information for a period as necessary.

The Company may retain your personal data for a period longer than the time prescribed if the law permits or necessary for the Company to establish the right of claim. At the end of such period or when your personal data is no longer needed, it will be deleted, destroyed or anonymized.

To exercise your rights as mentioned above may be restricted under relevant laws and in some cases it may be necessary for the Company to deny or be unable to meet your request such as to comply with the laws or court orders or such request may be in breach of rights or freedom of other persons, or the Company needs to exercise the right in compliance with relevant data retention law, in which case we will keep you informed and give reasons for denying your request.
